The Walton County Planning Commission will hold a public meeting to hear the following items on Wednesday, April 22, 2009, beginning at 1:00 p.m. at the South Walton County Courthouse Annex located at 31 Coastal Centre Boulevard, Santa Rosa Beach, Florida 32459:

LEGISLATIVE ITEMS:

A workshop to consider the EAR-based amendments to the Walton County Comprehensive Plan. This is a continuation from Tuesday, March 31, 2009.

The Planning Commission will make a recommendation to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any agenda item that is tabled will be scheduled for a future Planning Commission meeting and will not go forward to the Board of County Commissioners until the Planning Commission makes a recommendation.

PUBLIC HEARING NOTICE

The Walton County Zoning Board of Adjustment will hold their regular public hearing on April 23, 2009 at 6:00 P.M. at the South Walton Courthouse Annex in Santa Rosa Beach, Florida 32459. The following items are scheduled for review and action:

1. BUDDIG SUBDIVISION ADMINISTRATIVE APPEAL – Project number 08-004-00003. Scott Work on behalf of Buddig Subdivision is appealing an interpretation by Pat Blackshear, Director of Walton County Planning and Development Services Division, dated February 8, 2008. The interpretation stated that (1) Director Blackshear was designating the project a major development instead of a minor development pursuant to Section 11.01.02.C.6(b) of the Walton County Land Development Code, and (2) Director Blackshear was requiring the applicant to submit a compatibility analysis pursuant to Section 11.02.03.D.10 of the Walton County Land Development Code. The project is an 8 lot single family subdivision on 3.14 acres with a future land use of coastal center. The site is at 461 Driftwood Point Road (parcel number 14-2S-21-42000-006-0000).

The Zoning Board of Adjustment will make a final determination to grant a variance, deny a variance, uphold the director’s decision, overturn the director’s decision, or continue to a later date. Any agenda item that is tabled will be scheduled for a future Zoning Board of Adjustments meeting. The applicant/petitioner may appeal the decision of this board to the Circuit Court of Walton County.

The Department gives notice of its intent to find the Amendment to the Comprehensive Plan for The City of DeFuniak Springs, adopted by Ordinance No. 774 on February 23, 2009, IN COMPLIANCE, pursuant to Sections 163.3184, 163.3187 and 163.3189, F.S.

The adopted City of DeFuniak Springs Comprehensive Plan Amendment and the Department’s Objections, Recommendations and Comments Report (if any) are available for public inspection Monday through Friday, except for legal holidays, during normal business hours, at the City of DeFuniak Springs, City Hall Annex, 35 US Highway 90 West, DeFuniak Springs, Florida 32433.

Any affected person, as defined in Section 163.3184, F.S., has a right to petition for an administrative hearing to challenge the proposed agency determination that the Amendment to the City of DeFuniak Springs Comprehensive Plan is In Compliance, as defined in Subsection 163.3184(1), F.S. The petition must be filed within twenty one (21) days after publication of this notice, and must include all of the information and contents described in Uniform Rule 28-106.201, F.A.C. The petition must be filed with the Agency Clerk, Department of Community Affairs, 2555 Shumard Oak Boulevard, Tallahassee, Florida 32399 2100, and a copy mailed or delivered to the local government. Failure to timely file a petition shall constitute a waiver of any right to request an administrative proceeding as a petitioner under Sections 120.569 and 120.57, F.S. If a petition is filed, the purpose of the administrative hearing will be to present evidence and testimony and forward a recommended order to the Department. If no petition is filed, this Notice of Intent shall become final agency action.

If a petition is filed, other affected persons may petition for leave to intervene in the proceeding.
A petition for intervention must be filed at least twenty (20) days before the final hearing and must include all of the information and contents described in Uniform Rule 28 106.205, F.A.C. A petition for leave to intervene shall be filed at the Division of Administrative Hearings, Department of Management Services, 1230 Apalachee Parkway, Tallahassee, Florida 32399 3060. Failure to petition to intervene within the allowed time frame constitutes a waiver of any right such a person has to request a hearing under Sections 120.569 and 120.57, F.S., or to participate in the administrative hearing.

After an administrative hearing petition is timely filed, mediation is available pursuant to Subsection 163.3189(3)(a), F.S., to any affected person who is made a party to the proceeding by filing that request with the administrative law judge assigned by the Division of Administrative Hearings. The choice of mediation shall not affect a party’s right to an administrative hearing.

All bidders/proposers must be present at the designated start time of any pre-bid conference and must remain until the conference is adjourned. The County will not accept bids/proposals from any bidder/proposer arriving after the designated start time at listed in the Invitation to Bids or Request Proposal or departing prior to the adjournment of the pre-bid conference.

This Project is to construct a lifeguard shed to house lifeguard equipment used in their operation. Project consists of a 390 sq. ft. storage facility with an observation deck attached to the existing boardwalk structure. In addition, there is a 480 sq. ft. boardwalk for access from the parking lot to the project site.

The Walton County Planning Commission will hold a public meeting to hear the following items on Thursday, April 30, 2009, beginning at 1:00 p.m. at the South Walton County Courthouse Annex located at 31 Coastal Centre Boulevard, Santa Rosa Beach, Florida 32459:

LEGISLATIVE ITEMS:
A workshop to consider the EAR-based amendments to the Walton County Comprehensive Plan. This is a continuation from Wednesday, April 22, 2009.

The Planning Commission will make a recommendation to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any agenda item that is tabled will be scheduled for a future Planning Commission meeting and will not go forward to the Board of County Commissioners until the Planning Commission makes a recommendation.

In accordance with Section 286.26, Florida Statutes, whenever any board or commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision, which has scheduled a meeting at which official acts are to be taken receives, at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting, directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.

The Walton County Board of County Commissioners will hold a regular meeting on Tuesday, April 28, 2009, at 5:00 p.m. or as soon thereafter as may be heard at the Walton County Courthouse located at 571 U.S. Highway 90, DeFuniak Springs, Florida. The following items will be heard:

LEGISLATIVE ITEMS:

1. MINING ORDINANCE – An ordinance of Walton County, Florida amending the Walton County Land Development Code to add Chapter 16, mining regulations; providing for definitions, specifying design and operational standards for mines, procedures for approval of mines, providing fees; providing procedures for the determination of vested rights; providing for judicial review for the specific matters addressed herein; providing for conflict with other ordinances; providing for severability; and providing an effective date.

2. EAR-BASED AMENDMENT TO THE FUTURE LAND USE ELEMENT – Request that the Board consider Planning Commission recommendations on the proposed amendments to the Future Land Use Element of the Walton County Comprehensive Plan based upon the county’s Evaluation and Appraisal Report, as well as recommendations from the public.

3. WHISPERING SHORES SCRIVENER’S ERROR CORRECTIVE ORDINANCE – An ordinance amending Ordinance 2005-16 to correct the legal description of a parcel receiving a small-scale future land use map amendment; providing for findings of fact; and providing for an effective date.

QUASI-JUDICIAL ITEMS:

4. OWENS MINI WAREHOUSE & OFFICE COMPLEX – Project number 08-001-00069. This is a major development order application submitted by Greg Goodwin Construction requesting approval for a 5,967 square foot office building, 2 warehouse buildings totaling 7,000 square feet, 380 mini-storage units totaling 51,500 square feet, for a total of 64,467 square feet of commercial use on approximately 4.01 acres with a future land use of commercial. This site is at 26 Site C-6 Road, on the northeast corner of the intersection with Highway 20 (parcel number 12-1S-20-32000-067-0000).

5. MCDANIEL’S FISHCAMP A/K/A RVC USA FREEPORT – Project number 08-001-00064. This is a major development order application submitted by Porterfield Engineering, Inc. proposing to develop a commercial recreational vehicle park on 71.08 acres with a future land use of rural village. The site is on McDaniel’s Fishcamp Road (parcel numbers 02-2S-19-24000-034-0030 and 02-2S-19-24000-034-0040).

6. WHISPERING SHORES – Project number 07-001-00095. This is a major development application submitted by Jason Daniel, requesting approval for 17 single-family lots on 4.47 acres with a future land use of NPA-infill. The site is at 40 Whisper Lane (parcels numbers 10-2S-20-33000-002-0010, 10-2S-20-33000-002-0020, 10-2S-20-33000-002-0040, 10-2S-20-33000-0050, 10-2S-20-33000-002-0060, 10-2S-20-33000-002-007A, 10-2S-20-33000-002-0070, and 10-2S-20-33000-002-0080).

7. SAWYER COMMERCIAL PUD F/K/A SAWYER COMMERCIAL – Project number 07-001-00028. This is a major development application submitted by North Florida Capital, LLC, requesting conceptual approval of a commercial planned unit development. The applicant proposes to refurbish an existing structure and build 70,544 square feet of hotel in two phases on 5.67 acres with a future land use of coastal center. The site is at 11610 U.S. Highway 98 West (parcel numbers 29-2S-21-42000-003-00A0 and 29-2S-21-42000-003-00B0).

All interested parties wishing to be heard regarding these amendments may appear at the above mentioned meeting.
