Black Creek Landing-project consists of improving the existing boat launch facility and construction of additional parking along the right of way of CR 3280. In addition to the boat launch improvements, a timber dock will be constructed to assist in vessel launch and recovery.

Pt. Washington Boat Ramp-project consists of improving the existing boat launch facility and construction of additional parking area at the end of CR 395 (Pt. Washington Road). In addition to the boat launch improvements, a timber dock will be constructed to assist in vessel launch and recovery and a timber fishing dock will be constructed to the west of the launch facility.

Portland Park Boat Ramp-project consists of improving the existing boat launch facility and construction of additional parking area at the end of Portland Park Road. In addition to the boat launch improvements, a timber fishing dock will be constructed to assist in vessel launch and recovery.

River Road Boat Ramp-project consists of improving the existing boat launch facility River Road. In addition to the boat launch improvements, a timber dock will be constructed to assist in vessel launch and recovery. All existing parking areas will be updated with new lime rock for stabilization.

All disturbed areas associated with the proposed improvements shall be sodded.

The Walton County Code Enforcement Board will hold their regular meeting on March 19, 2009 beginning at 6:00 p.m. to be held at the South Walton Courthouse Annex.

REQUEST FOR PROPOSALS
PROFESSIONAL ENVIRONMENTAL & ARCHEOLOGICAL SERVICES
The City of Freeport is soliciting Professional ENVIRONMENTAL and/or ARCHEOLOGICAL services from qualified firms to assist the City in its efforts to secure a utility easement from Eglin, AFB for the construction of a 12” diameter water transmission main from Alaqua Drive (Portland) to Eastern Street (Choctaw Beach). This approximately 7.5 mile line segment will be located within the confines of the existing SR 20 FDOT right-of-way. Additional data including a Project Narrative and Location Map are available from the City Clerk, upon request, call (850) 835-2822. Proposals will be received by Robin Haynes, City Clerk, City of Freeport, 112 Hwy. 20 West (P.O. Box 339), Freeport, FL 32439, (850) 835-2822, until 2:00 p.m. (local time) March 20, 2009.

Services requested include but are not necessarily limited to: the preparation of 1) an Environmental Baseline Survey (EBS); 2) an Environmental Assessment (EA) report; and 3) an ARCHEOLOGICAL Survey. All services provided shall be in accordance with the Federal National Environmental Policy Act (NEPA) and subject to Eglin AFB procedures and requirements as outlined in 32 CFR 989.

All proposers must have had prior satisfactory experience in providing said services on similar projects within the Eglin AFB Reservation. Documentation of previous experience must be submitted with the project proposal.

All proposals shall include, as a minimum:
1) Evidence of qualification to perform the services offered.
2) Project narrative outlining the Consultants project approach and identifying specific tasks and timetables for completion.
3) List of similar projects on Eglin AFB for which the requested services have been provided.
4) Estimate of the cost of providing those services anticipated in conjunction with this endeavor and identifying any contingent fees which may be required due to an expanded scope of work.

Proposals may include both Archeological and Environmental services, however, evidence of qualifications for each specialty must be provided. Singular proposals for each specialty (i.e., Archeological or Environmental) will be considered. A total of ten (10) copies of each proposal must be submitted.

Proposals will be evaluated based on content, qualifications, proposed schedule and cost. Award will be based on the entirety of the proposal and what the City feels is in its best interest. Although cost is a consideration, it will not necessarily be the determining factor.

The Walton County Board of County Commissioners will hold a regular meeting on Tuesday, March 24, 2009, at 5:00 p.m. or as soon thereafter as may be heard at the Walton County Courthouse located at 571 U.S. Highway 90, DeFuniak Springs, Florida. The following items will be heard:

LEGISLATIVE ITEMS:

1. RECREATION FEES ORDINANCE – An ordinance amending the Walton County Land Development Code section 11.03.03 to establish a procedure for valuing platted land for the purpose of calculating recreation impact fees for subdivisions, providing for severability, and providing an effective date.

2. PRESERVATION FEES ORDINANCE – An ordinance amending the Walton County Land Development Code section 4.06.02 to establish a procedure for valuing land area for the purpose of calculating preservation buy out fees for subdivisions, providing for severability, and providing an effective date.

3. DEVELOPMENT ORDER EXTENSION ORDINANCE – An ordinance of Walton County, Florida, amending sections 11.01.05.b and 11.01.06.c of the Walton County Land Development Code to extend the time in which minor and major development orders shall remain valid by one year; providing a sunset provision; providing for retroactive effect of the amendment; and providing an effective date.

4. MINING ORDINANCE – An ordinance of Walton County, Florida amending the Walton County Land Development Code to add Chapter 16, mining regulations; providing for definitions, specifying design and operational standards for mines, procedures for approval of mines, providing fees; providing procedures for the determination of vested rights; providing for judicial review for the specific matters addressed herein; providing for conflict with other ordinances; providing for severability; and providing an effective date.

5. EAR-BASED AMENDMENT TO THE FUTURE LAND USE ELEMENT – Request that the Board consider Planning Commission recommendations on the proposed amendments to the Future Land Use Element of the Walton County Comprehensive Plan based upon the county’s Evaluation and Appraisal Report, as well as recommendations from the public.

QUASI-JUDICIAL ITEMS:

6. WALTON COUNTY APARTMENTS PUD – Project number 08-001-00055. This is a major development order application submitted by Connelly & Wicker, Inc., requesting conceptual approval of 261 multifamily rental units within 9 buildings and 7,700 square feet for office/bank use on 46.27 +/- acres with a future land use of small neighborhood. The site is on the east side of U.S. 331, approximately 1,600 feet south of Chat Holly Road (parcel numbers 29-2S-19-24000-004-0000 and 29-2S-19-24000-008-0000).

7. ISLAND ESTATES LOT 9 REPLAT – Project number 08-003-00019. This is a plat application submitted by Preble-Rish, requesting the replat of lot 9 and the associated common area on .318 acres with a future land use of coastal center. The site is south of U.S. 98 on Portside Terrace (parcel numbers 34-2S-21-42900-000-0090 and 34-2S-21-42900-000-00A0).

8. CASSINE VILLAS PLAT – Project number 06-003-00053. This is a plat application submitted by Emerald Coast Associates, requesting final plat approval for 3 single-family lots on +/- 0.49 acres with a future land use of RPA. The site is off Cassine Circle, north of C.R. 30A (24-3S-19-25000-017-0000).

9. SEABREEZE VILLAS – Project number 08-001-00019.  This is a major development order application submitted by Connelly & Wicker, Inc., consisting of 4 townhome buildings with a total of 14 units, and a pool on 1.64 acres with a future land use of NPA/RP.  The site is located at the northwest corner of Seabreeze Trail and Seabreeze Boulevard, just north of C.R. 30A (parcel number 28-3S-18-16141-00A-0580).

10. JUSTICE BUILDING – Project number 08-001-00067. This is a major development order application submitted by Barnhill, Barnhill, and Barnhill, requesting approval for three (3) two-story metal buildings totaling 20,000 square feet on approximately 2.56 acres with a future land use of commercial. The site is at the intersection of U.S. 331 South and Jolly Bay Road (parcel number 04-2S-19-24000-001-0120).

11. CYBONEY RV PARK ABANDONMENT – Project number 08-008-00005. This is an abandonment application submitted by Robert Somerville. The association for the Cyboney RV Park is requesting the abandonment of the east/west easement, as established by deed recorded in Deed Book 143, page 115, bisecting the RV Park. This proposed abandonment area is within the Cyboney RV Park, north of Cyboney Condominiums, access off Scenic Gulf Drive, adjacent to Crystal Village Condominiums.

12. PLANTATION SUBDIVISION DEEDED EASEMENT ABANDONMENT – Project number 08-008-00004. This is an abandonment application submitted by Walton County. Upon the failure of the successful bidder to complete the purchase pursuant to these Terms of Sale, the LLC, in its sole discretion may, on any number of occasions, either accept the next highest bid or re-notice the sale or make other arrangements. Any such alternate arrangements shall be governed by these Terms of Sale unless a subsequent sale is held, or alternative arrangements are made, with regard to which different Terms of Sale are applicable.

8. Purchasers are advised that the LLC is the holder of a security interest in the Collateral and that, pursuant to UCC §9-504, any proceeds received by the LLC from the sale of the Collateral shall be applied (a) to the LLC to reimburse it for the expenses of this auction, (b) to the LLC and its agents and attorneys for payment of all monies due on behalf of and from the Holder of the Collateral, its agents and attorneys, under any LLC documents, these Terms of Sale, and law (including, but not limited to, attorneys’ fees in connection with the Member’s default) and (c) to the Member in payment of its indebtedness under its Operating Agreement with the LLC. Any balance remaining will be paid to the Member.

9. The LLC or its nominee(s), designee(s) or assignee(s) reserve the right to bid at this sale, shall not be required to post a deposit with the Auctioneer and may credit against the purchase price bid any or all sums due to the LLC as set forth in Schedule A.

10. The successful bidder covenants and agrees to execute all documents which reasonably may be required in connection with the transfer of the Collateral.

11. The Collateral is being sold by the LLC pursuant to its rights under the Uniform Commercial Code. Purchasers are advised that there is an Operating Agreement and a list of assets owned by the LLC available for inspection by appointment prior to the auction. PROSPECTIVE PURCHASERS ARE STRONGLY URGED TO REVIEW THE PLAN PRIOR TO THE BIDDING. The Collateral is being offered as part of a public offering.

12. This sale is without recourse to the Auctioneer or the LLC or the escrow agent.

13. In the event of a dispute between bidders, the Auctioneer reserves the right to determine the successful bidder or to offer the Collateral for resale.

14. The record of sale maintained by the Auctioneer’s bookkeeper will be absolute and final in all disputes.

PUBLIC HEARING NOTICE

You are hereby notified that a Petition for Abandonment submitted by Robert Somerville regarding:

To abandon a 33’ easement traveling east/west at the end of Payne Street, through the center of Cyboney RV Park, being further described as:

Township 2 South, Range 21 West, Section 30, Lot 69, being a 33’ foot easement for roadway and public utilities located along the southern boundary of the land, per recorded deed in OR Book 143, Page 115, public records of Walton County, Florida.

This petition for abandonment will be heard at 5:00 p.m. or as soon thereafter on March 24, 2009, by the Walton County Board of County Commissioners at the Walton County Courthouse at 571 U.S. Highway 90, DeFuniak Springs, Florida.

In accordance with Section 286.26, Florida Statutes, whenever any board or commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision, which has scheduled a meeting at which official acts are to be taken receives, at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting, directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.
