Successful Bidder shall be required to execute and to provide a Payment Bond and Performance Bond each in an Amount of not less than one hundred percent (100%) of the total value of the Contract awarded to him with a satisfactory surety or sureties for the full and faithful performance of the work.

No bid may be withdrawn after closing time for the receipt of Proposals for a period of ninety (90) days.

NOTICE OF PUBLIC HEARING

The Walton County Board of County Commissioners will hold a regular meeting on Tuesday, May 27, 2008, at 5:00 p.m. or as soon thereafter as may be heard at the Walton County Courthouse located at 571 U.S. Highway 90, DeFuniak Springs, Florida. The following items will be heard:

LEGISLATIVE ITEMS:

1. DEVELOPMENT ORDER EXTENSION ORDINANCE – An ordinance of Walton County, Florida, amending sections 11.01.05.b and 11.01.06.c of the Walton County Land Development Code to extend the time in which minor and major development permits shall remain valid by one year; providing a sunset provision; providing additional flexibility for workforce/affordable housing development orders; providing for retroactive effect of the amendment; and providing an effective date.

2. ASSISI VILLAS PUD PHASING PLAN REVISION – Project number 07-001-00052. Hanie Nasri, applicant is requesting a revision to the phasing plan of Assisi Villas PUD. The applicant is requesting to increase from 2 to 3 phases. The site is located on the east side of Thompson Road, approximately 1,400 feet south of U.S. 98 (parcel numbers 34-2S-20-33270-060-0000, 34-2S-20-33270-060-0001, and 34-2S-20-33270-060-0002.)

QUASI-JUDICIAL ITEMS:

3. WHISPERING LAKE PUD – Project number 07-001-00108. This is a major development order application submitted by Moore Bass Consulting consisting of 28 multi-family townhomes, (2) 4-plex units, (16) 2-plex units, (15) 8-plex units, 100 Senior Living Apartments, and a 65,340 sq. ft. Assisted Living Facility, totaling 296 residential units to be sold to individual owners. This project is 29.65(+/-) acres with a future land use of small neighborhood. 4. THE STABLES AT SANDY PINES PLAT – Project number 08-003-00004. This is a plat application submitted by Les Porterfield, requesting approval for a 32 lot single-family subdivision on 320.05 acres with a future land use of general agriculture. The site is located on Buddy McGill Trail, west of Highway 81 North (parcel numbers 05-1N-17-04000-001-0020, 05-1N-17-04000-001-0030, and 05-1N-17-04000-001-0040.)

5. BAYPORT SSA 2008-01 – Walton County is requesting a small scale amendment to change 9.74 +/- acres from rural village to commercial, or any less dense or intense category. The parcel is located north of Choctawhatchee Bay and more specifically on the north side of C.R. 3280 (Black Creek Road), approximately 1,000 feet east of the intersection of C.R. 3280 and U.S. 331 (parcel number 34-1S-19-23000-007-0020.)

6. STRICKLAND SSA 2008-02 – Jim Strickland is requesting a small scale amendment to change 9.82 +/- acres from rural residential to rural village, or any less dense or intense category. The parcel is located north of Choctawhatchee Bay in the Mossy Head area on the west side of Hinote Road, approximately 1.4 miles north of U.S. 90 (parcel number 15-3N-21-37000-001-0030.)

7. JUSTICE SSA 2008-03 – Joe Justice is requesting a small scale amendment to change 2.93 +/- acres from rural village to commercial, or any less dense or intense category. The parcel is located north of Choctawhatchee Bay at the northeast corner of Jolly Bay Road and U.S. 331 (parcel number 04-2S-19-24000-001-0120.)

8. POWERSOUTH ENERGY COOPERATIVE SSA 2008-04 – Walton County is requesting a small scale amendment to change 2.0 +/- acres from conservation to public facilities, or any less dense or intense category. The parcel is located south of the Choctawhatchee Bay on the east side of East Hewitt Road, approximately 1,250 feet north of U.S. 98 (parcel number 29-2S-20-33000-011-0000.)

9. SOUTH WALTON FIRE DISTRICT SSA 2008-05 – Walton County is requesting a small scale amendment to change 0.28 +/- acres from public facilities to infill, or any less dense or intense category. The parcel is located south of the Choctawhatchee Bay on the east side of C.R. 395, approximately 0.4 mile north of C.R. 30A (parcel number 14-3S-19-25000-004-0030.)

10. M.C. DAVIS SSA 2008-07 – Walton County is requesting a small scale amendment to change 10.0 +/- acres from conservation to conservation residential 2:1, or any less dense or intense category. The parcel is located south of the Choctawhatchee Bay on the west side of Church Street, approximately 3,200 feet north of U.S. 98 (parcel number 27-2S-20-33210-000-0390.)

11. BUSHEE SSA 2008-09 – Christopher Bushee is requesting a small scale amendment to change 2.65 +/- acres from rural village to commercial, or any less dense or intense category. The parcel is located north of the Choctawhatchee Bay at the southwest corner of U.S. 331 and Russell Road; approximately 3.75 miles north of the DeFuniak Springs city limits (parcel number 06-3N-19-19770-000-0010.)

12. BURGESS SSA 2008-10 – Susan Burgess is requesting a small scale amendment to change 0.255 +/- acres from residential preservation to infill, or any less dense or intense category. The parcel is located south of the Choctawhatchee Bay in the Homestead platted subdivision on the south side of C.R. 30A, approximately 1.2 miles east of C.R. 395 (parcel number 24-3S-19-25180-000-0030.)

13. M.C. DAVIS SSA 2008-11 – M.C. Davis is requesting a small scale amendment to change 10.0 +/- acres from conservation to conservation residential 2:1, or any less dense or intense category. The parcel is located south of the Choctawhatchee Bay on the west side of Church Street, approximately 3,500 feet north of U.S. 98 (parcel number 27-2S-20-33210-000-0410.)

Stormwater Application

Notice is hereby given that pursuant to Chapter 373, Florida Statutes and Chapter 62-346, Florida Administrative Code (F.A.C.), the following applications for an Individual Stormwater Permit have been received by the Northwest Florida Water Management District:

Application #226 received on April 2, 2008, from John King, Indian Creek of Destin, Inc., for modification of the existing stormwater treatment for Botany Bayou, a 71 lot single family subdivision in Santa Rosa Beach off of Los Roblas Grande Drive. The existing stormwater system does not recover and sand bottom filters are proposed with discharge to Hewett Bayou.

Application #240 received April 9, 2008, from A. Craig Le Crone, Best Way Pizza., for the development of LeHigh Pines, with 43 single family lots and 2 commercial out-parcels, including two separate stormwater treatment areas for the 43 family lots. The project is located on the south side of Chat Holley Road, 0.28 miles east of J.D. Miller Road, Santa Rosa Beach.

Application #257 received April 24, 2008, from the Walton County Public Works Dept. for demolition of the existing public parking lot and reconstruction of a new lot providing more parking spaces and an improved stormwater management system on Scenic Gulf Drive, Tax Parcel 330-2S-21-42290-000-1200, Miramar Beach.

Application #269 received May 1, 2008 from Steve Hufstetler, Teramore Development, for construction of a 9,014 square foot free standing retail Dollar Store, including paved drive and parking areas, concrete walkways, landscape area and stormwater management system, at the corner of Hwy. 90 & Lancelot Road in Mossy Head.

Interested persons may comment upon these applications or submit a written request for a staff report containing proposed agency action regarding the application by writing the Northwest Florida Water Management District’s ERP Office, 800 Hospital Dr., Crestview, FL. Such comments or requests must be received by 5:00 p.m. within 14 days from date of publication.

No further public notice will be provided regarding these applications. Persons wishing to remain advised of further proceedings or to receive a copy of the Technical Staff Report should request that in writing to the address above or by e-mail to ErpPermits@nwfwmd.state.fl.us.

NOTICE OF RULE DEVELOPMENT BY THE SCHOOL BOARD OF WALTON COUNTY, FLORIDA

The School Board of Walton County, Florida, pursuant to the provisions of Section 120.54, Florida Statutes, hereby gives notice that it is developing a new school board rule, the title of which is Walton County School District Wellness Policy 2007.
The proposed rule deals with the subject area of wellness for students and the purpose and effect of the proposed rule is to set forth the School District Policy on wellness for all students. The specific legal authority for the proposed rule is Section 1001.41, 1001.42, 1001.43, 1003.42, 1006.06, 1006.0606, 1003.429, 1003.43, and 381.0056, Florida Statutes, and the laws implemented are Child Nutrition Act of 1966 (42 USC 1771 et seq) Richard B. Russell National Lunch Act PL 108-265, Section 204, and State Board of Education Rules 6A-7.0411.
