Mandatory Pre-Bid will be held on February 18, 2009 at 9:00AM at the Walton County Training and Conference Center (formally known as the Wee Care Park) 552 Walton Road, DeFuniak Springs, Florida 32435. Bidders, who arrive late, will be allowed to attend the pre-bid, but will not be allowed to submit a bid.
All bidders/proposers must be present at the designated start time of any pre-bid conference and must remain until the conference is adjourned. The County will not accept bids/proposals from any bidder/proposer arriving after the designated start time at listed in the Invitation to Bids or Request Proposal or departing prior to the adjournment of the pre-bid conference.

Contact the Office of Central Purchasing for availability of drawings. Fee is $75.00 non-refundable.

Bid closing date is March 2, 2009 no later than 12:00 Noon and will open immediately thereafter.

Project CR 192 is a 4.5 mile paved road located approximately six (6) miles north of DeFuniak Springs consisting of an east/west alignment connecting SR 83 to US 331. The project will consist of milling 3-inches of existing asphalt and widening the road from ± 20 feet to 24 feet. Approximately 660 feet of concrete ditch will be removed and replaced as part of this project. The proposed roadway will consist of 3.0 inches of SP 12.5 asphalt. The existing sand/clay base will be mixed in place and shall have a minimum LBR of 70. All disturbed areas along the proposed improvements shall be sodded.

    NOTICE OF INTENT OF THE SCHOOL BOARD OF WALTON COUNTY, FLORIDA TO AMEND THE 2008-2009 STUDENT PROGRESSION PLAN

The School Board of Walton County, Florida, hereby gives notice of its intent to amend the 2008-2009 Student Progression Plan, which by reference is incorporated as part of School Board Rules, pursuant to the procedures set forth in the Administrative Procedures Act.

PURPOSE AND EFFECT: The purpose and effect of the 2008-2009 Student Progression Plan is to present to school personnel, parents/guardians, students and other interested citizens the administrative procedures required to implement state legislative and local pupil progression requirements.

SUMMARY: The District Student Progression Plan is adopted each year by the School Board of Walton County, Florida, and sets forth the policies and procedures relative to enrollment, promotion, retention, accelerated/decelerated placement, transfers, instructional programs, accelerated programs, extended year programs, dropout prevention/retrieval programs, student assessment and exceptional student education.

LEGAL AUTHORITY: The adoption and amendment of the 2008-2009 Student Progression Plan is authorized by Sections 1001.41, 1008.25, 1008.34, 1001.03 and 1008.22 Florida Statutes, and the law implemented is Section 1008.25 Florida Statutes.

ECONOMIC IMPACT: The amendment of the 2008-2009 Student Progression Plan will not result in any additional costs to the School District.
A public hearing will be held by the School Board of Walton County, Florida, at 5:15 p.m. during the regular board meeting on February 17, 2009, in the Board Room at the Tivoli Administrative Complex, 145 Park Street, DeFuniak Springs, Florida, for the purpose of considering amendment of the 2008-2009 Student Progression Plan. Any interested person may appear at the hearing and present evidence and argument and be heard concerning the amendment of the 2008-2009 Student Progression Plan. Immediately following the public hearing the School Board of Walton County, Florida, will consider final action to amend the 2008-2009 Student Progression Plan.
The entire text of the 2008-2009 Student Progression Plan is on file and available for inspection during regular office hours at the office of the Superintendent of Schools, Walton County, Florida, located at 145 Park Street, Suite 2, DeFuniak Springs, Florida. Copies of the 2008-2009 Student Progression Plan are available to the public at the Superintendent’s office.
If a person decides to appeal any decision made by the School Board with respect to any matter considered at such meeting or hearing, such person will need a record of the proceedings, and for such purpose, such person may need to ensure that a verbatim record of the proceedings, which record include the testimony and evidence upon which the appeal is to be based.

3. PRESERVATION FEES ORDINANCE – An ordinance amending the Walton County Land Development Code section 4.06.02 to establish a procedure for valuing land area for the purpose of calculating preservation buy out fees for subdivisions, providing for severability, and providing an effective date.

QUASI-JUDICIAL ITEMS:

4. SEABREEZE VILLAS – Project number 08-001-00019.  This is a major development order application submitted by Connelly & Wicker, Inc., consisting of 4 townhome buildings with a total of 14 units, and a pool on 1.64 acres with a future land use of NPA/RP.  The site is located at the northwest corner of Seabreeze Trail and Seabreeze Boulevard, just north of C.R. 30A (parcel number 28-3S-18-16141-00A-0580).

5. JUSTICE BUILDING – Project number 08-001-00067. This is a major development order application submitted by Barnhill, Barnhill, and Barnhill, requesting approval for three (3) two-story metal buildings totaling 20,000 square feet on approximately 2.56 acres with a future land use of commercial. The site is at the intersection of U.S. 331 South and Jolly Bay Road (parcel number 04-2S-19-24000-001-0120).

The Planning Commission will make a recommendation to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any agenda item that is tabled will be scheduled for a future Planning Commission meeting and will not go forward to the Board of County Commissioners until the Planning Commission makes a recommendation.

The Walton County Technical Review Committee will hold a public hearing on Wednesday, February 18, 2009 at 8:30 am at the South Walton Courthouse Annex in Santa Rosa Beach, FL 32459. The following items are scheduled for review and action:

1. SEASIDE TOWN CENTER 30A IMPROVEMENTS – Project number 09-001-00001. This is a minor development order application submitted by Emerald Coast Associates for Seaside Town Center. Improvements consist of parking apron improvements, tree plantings, 327 square feet of commercial space, and a brick paved plaza on 1.17 acres with a future land use of NPA/RPA. The project is at 2235 East C.R.30A, within a commercial area of the Seaside Development of Regional Impact (parcel number 15-3S-19-25000-002-00A0).

2. CYBONEY RV PARK ABANDONMENT – Project number 08-008-00005. This is an abandonment application submitted by Robert Somerville. Members of the Cyboney, LLC RV Park and property owners request the abandonment of the Payne Street easement running through the RV Park, going east to west, per Deed Book 143, page 115. If the abandonment is granted, they will dedicate a strip of land approximately 8 feet x 329 feet, on the west side of Government Lot 069, parallel to Professional Place and adjacent to Crystal Village Condominiums to Walton County.

3. PLANTATION SUBDIVISION DEEDED EASEMENT ABANDONMENT – Project number 08-008-00004. This is an abandonment application submitted by Walton County. The Plantation deeded easement abandonment consists of an abandonment of the 50-foot easement on either side of the centerline of the platted roads within Plantation Subdivision recorded in 1978.  The deeded easement is in OR Book 203, page 562, over the 50-foot platted roads in the Plantations Subdivision, per Plat Book 5, Page 22-22a.  This abandonment serves to correct the typographical error, which should have read a 25-foot easement on either side of the centerline of the platted roads within Plantation Subdivision to comprise a 50-foot easement.

In accordance with Section 286.26, Florida Statutes, whenever any board of commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision, which has scheduled a meeting at which official acts are to be taken receives, at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.

NOTICE OF INTENT TO ISSUE PERMIT
This intent to issue a permit (File No. 66-291144-001-DF) to Walton County BOCC, Public Works Department, 97 Montgomery Circle, DeFuniak Springs, FL 32435, to impact 0.23 acres of jurisdictional wetlands for the construction of an eight foot wide by 1.75 mile long bike/pedestrian path along Lake Road, with enhancement and preservation of 1.64 acres of offsite wetlands, is hereby granted unless a sufficient petition for an administrative hearing is timely filed under sections 120.569 and 120.57 of the Florida Statutes as provided below.

The project is located along Lake Road in Laurel Hill, Section 27, Township 6 North, Range 21 West, adjacent to Lake Jackson, Class III Waters of the State, Latitude: 30°59’12.38”, Longitude: -86°19’39.36”, in Walton County. The offsite mitigation property is located at 5900 Long Road in DeFuniak Springs, Section32 Township 5 North, Range 21 West, Latitude: 30°52’54.74”N, Longitude: 86°21’42.97”W, in Walton County.

The procedures for petitioning for a hearing are set forth below.

A person whose substantial interests are affected by the Department’s action may petition for an administrative proceeding (hearing) under sections 120.569 and 120.57 of the Florida Statutes. The petition must contain the information set forth below and must be filed (received by the clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000.

Because the administrative hearing process is designed to redetermine final agency action on the application, the filing of a petition for an administrative hearing may result in a modification of the permit and lease, or even a denial of the application. Accordingly, the applicant is advised not to commence construction or other activities under this permit/lease until the deadlines below for filing a petition for an administrative hearing, or request for an extension of time have expired.

Under rule 62-110.106(4) of the Florida Administrative Code, a person whose substantial interests are affected by the Department’s action may also request an extension of time to file a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time. Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, before the applicable deadline. A timely request for extension of time shall toll the running time period for filing a petition until the request is acted upon. If a request is filed late, the Department may still grant it upon a motion by the requesting party showing that the failure to file a request for an extension of time before the deadline was the result of excusable neglect.

In the event that a timely and sufficient petition for an administrative hearing is filed, other persons whose substantial interests will be affected by the outcome of the administrative process have the right to petition to intervene in the proceeding. Intervention will be only at the discretion of the presiding officer upon the filing of a motion in compliance with rule 28-106.205 of the Florida Administrative Code.

In accordance with rules 28-106.111(2) and 62-110.106(3)(a)(4), petitions for an administrative hearing by the applicant must be filed within 21 days of receipt of this written notice. Petitions filed by any persons other than the applicant, and other than those entitled to written notice under section 120.60(3) of the Florida Statutes, must be filed within 21 days of publication of the notice or within 21 days of such notice, regardless of the date of publication.

Under section 120.60(3) of the Florida Statutes, however, any person who has asked the Department for notice of agency action may file a petition within 21 days of such notice, regardless of the date of publication.

The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing. The failure of any person to file a petition for an administrative hearing or pursue mediation as provided below within the appropriate time period shall constitute a waiver of those rights.

A petition that disputes the material facts on which the Department’s action is based must contain the following information:

(a) The name and address of each agency affected and each agency’s file or identification number, if known;

(b) The name, address, and telephone number of the petitioner; the name, address, and telephone number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests are or will be affected by the agency determination;

(c) A statement of when and how the petitioner received notice of the agency decision;

(d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate;

(e) A concise statement of the ultimate facts alleged, including the specific facts that the petitioner contends warrant reversal or modification of the agency’s proposed action; and

(f) A statement of the specific rules or statutes that the petitioner contends requires reversal or modification of the agency’s proposed action;

(g) A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wishes the agency to take with respect to the agency’s proposed action.

A petition that does not dispute the material facts on which the Department’s action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by rule 28-106.301. Under sections 120.569(2)(c) and (d) of the Florida Statutes, a petition for administrative hearing must be dismissed by the agency if the petition does not substantially comply with the above requirements or is untimely filed.

This action is final and effective on the date filed with the Clerk of the Department unless a petition is filed in accordance with the above. Upon the timely filing of petition this order will not be effective until further order of the Department.

This permit constitutes an order of the Department. The applicant has the right to seek judicial review of the order under section 120.68 of the Florida Statutes, by the filing of a notice of appeal under rule 9.110 of the Florida Rules of Appellate Procedure with the Clerk of the Department in the Office of General Counsel, 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida, 32399-3000; and by filing a copy of the notice of the appeal accompanied by the applicable filing fees with the appropriate district court of appeal. The notice of appeal must be filed within 30 days from the date when the final order is filed with the Clerk of the Department. Requests for review before the Land and Water Adjudicatory Commission must be filed with the Secretary of the Commission and served on the Department within 20 days from the date when the final order is filed with the Clerk of the Department.

The application is available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at Department of Environmental Protection, 160 Governmental Center, Suite 201, Pensacola, Florida 32502-5794.
