Mandatory Pre-Bid will be held on December 11, 2008 at 2:00 PM at the Office of Public Works Engineer, 97 Montgomery Circle, DeFuniak Springs, Florida 32435. Bidders, who arrive late, will be allowed to attend the pre-bid but will not be allowed to submit a bid.

All bidders/proposers must be present at the designated start time of any pre-bid conference and must remain until the conference is adjourned. The County will not accept bids/proposals from any bidder/proposer arriving after the designated start time as listed in the Invitation to Bids or Request Proposal or departing prior to the adjournment of the pre-bid conference.

Contact the Office of Central Purchasing for availability of drawings. Fee is $100.00 non-refundable.

Bid closing date is January 5, 2009 no later than 4:00 PM and will open immediately thereafter.

Project consists of demolition of existing bridge crossing Four Mile Creek and replacing with new construction. The construction will consist of two (2) approach bridges in either end of an 80 linear foot center span. The new span will have enough clearance below the bridge deck and superstructure to allow small vessels to navigate.

The proposed improvements to the property include the installation of ±14,000 sf of parking and access aisle, ±900 sf of concrete boat ramp, and stormwater retention areas as required by Florida Department of Environmental Protection. SIDEWALK ORDINANCE – An ordinance amending Walton County Land Development Code §5.04.03h to allow the County Engineer discretion to waive the construction of sidewalks and/or a contribution to the sidewalk fund for sidewalks in rural areas; providing for severability, providing for conflict, and providing an effective date.

3. WILDLIFE CONSERVATION ORDINANCE – An ordinance amending Chapter 5 of the Walton County Land Development Code to establish a wildlife conservation zone with lighting standards in Walton County; providing for a purpose and applicability; providing for definitions; providing standards for new construction activities; providing standards for existing exterior lighting; providing for enforcement and penalties; providing for interpretation, severability, and an effective date.

QUASI-JUDICIAL ITEMS:

4. ALDYNE HOLUB SSA 2008-16 – Darrell Barnhill is requesting a small scale amendment to change 0.98 +/- acres from urban residential to commercial, or any less dense or intense category. The parcel is located north of the Choctawhatchee Bay on the east side of S.R. 83, approximately 580 feet north of Walton Road (parcel number 23-3N-19-19000-003-0030).

5. HSH PROPERTIES, LLLP SSA 2008-17 – HSH Properties, LLLP is requesting a small scale amendment to change up to 10 acres from large scale agriculture to NBNPA/mixed use residential, or any less dense or intense category. 6. SLATTERY INDUSTRIAL SITE MASTER PLAN AND PHASE I TECHNICAL DEVELOPMENT ORDER EXTENSION – Project number 05-001-00122. South Haven Townhomes, LLC is requesting a one-year extension of an already approved major development order issued January 10, 2008, as prescribed by code. The development order approved a 40,480 square foot, two phase, 40 unit warehouse and office space industrial complex on 5.75 acres with a future land use of light industrial. Phase I consists of 19 warehouse/office space units totaling 21,252 square feet. The site is located on the west side of C.R. 393, south of Edgewood Terrace.

7. HIGHLAND PARKS AT BLUE MOUNTAIN BEACH PHASE 1 REPLAT – Project number 08-003-00014. This is a plat application submitted by Daryl Burgis, PLS, requesting a replat of the common preservation area for the previously approved development orders 04-000-00014, 05-001-00036, and 07-013-00038. The site is at 2918 West C.R. 30A (parcel number 01-3S-20-34000-009-0010).

8. BLACK CREEK PLANTATION PUD – Project number 06-001-00112. This is a major development order application for a conceptual planned unit development submitted by Ed Stanford, and Blackcreek Developers LLC, consisting of 652 single family units, 97 multi-family units, 60,000 square feet of commercial, 29,500 square feet of boat dry storage, as well as public and civic uses on 300 +/- acres with a future land use of NBNPA/RTC. The site is on the north side of Black Creek Road approximately 2 miles east of the Black Creek Boulevard and Black Creek Road intersection (parcel numbers 04-2S-18-15000-001-0030, 33-1S-18-14000-001-0030, 04-2S-18-15000-001-0020, 04-2S-18-15000-001-0040, and 04-2S-18-15000-001-0050).

9. TROUT BRANCH INDUSTRIAL PARK PLAT – Project number 07-003-00023. This is a final plat application submitted by Darrell Barnhill, requesting approval for a 13 lot industrial subdivision on 23.20 acres with a future land use of light industrial. The site is on the north side of S.R. 20 directly across from Cedar Beach Cove (parcel numbers 19-1S-20-32000-005-000 & 19-1S-20-32000-003-0000).

The Walton County Planning Commission will hold a public meeting on Thursday, December 11, 2008, at the South Walton County Courthouse Annex located at 31 Coastal Centre Boulevard, Santa Rosa Beach, Florida 32459, beginning at 3:00 p.m., for a continued workshop on EAR-based amendments, followed by their regularly scheduled meeting at 5:00 p.m., to hear the following items:

LEGISLATIVE ITEMS:

1. POINT WASHINGTON ORDINANCE – An ordinance amending Chapters five and ten of the Walton County Land Development Code to provide additional notice requirements for projects in the Point Washington area; providing for severability and providing an effective date.

QUASI-JUDICIAL ITEMS:

2. SAINT RITA CATHOLIC CHURCH FAMILY LIFE CENTER – Project number 08-001-00048. This is a major development order application submitted by Moore Bass Consulting, requesting approval of a Master Plan to amend their previously approved development order. This Master Plan will consist of five phases, adding 25,127 square feet to the existing 21,783 square feet, for a total of 46,910 square feet. Phase I will include relocating two existing portable classroom buildings, the addition of three portable classroom buildings, the installation of covered walkways connecting the classroom buildings to the existing administration building, and the construction of a new parking lot. Phase II will include installation of a boardwalk connecting the campus to the existing main church and parking. Phase III will include construction of a gymnasium, including amenities. Phase IV will consist of the Family Life Center construction and additional parking. Phase V will consist of constructing additional covered walkways that will connect the new buildings to the existing church. The site is on the east side of Moll Drive, approximately 600 feet south of U.S. 98 (parcel number 34-2S-20-33270-030-0000).

3. SOUTHWIDE BAPTIST CHURCH FAMILY LIFE CENTER – Project number 08-001-00040. This is a major development order application submitted by Scott Jenkins, consisting of the addition of a 28,292.5 square foot family life center and a parking lot to the existing Southwide Baptist Church. The project is on 35.88 acres with a future land use of general agriculture. The site is at the intersection of Coy Burgess Loop and Millard Gainey Road (parcel number 09-2N-19-18000-003-0000).

4. BMW INVESTMENTS ABANDONMENT, REPLAT, AND DEVELOPMENT ORDER AMENDMENT – Project numbers 08-008-00002, 06-002-00035, and 07-001-00027. This is an application for an abandonment via a replat submitted by Dan Arner on behalf of BMW Investments, and a request to amend development order number 1368 for BMW Warehouse and Offices increasing the FAR from 7,000 square feet to 13,387 square feet of warehouse and office space. BMW Investments is seeking to correct code violations and encroachments through the abandonment of the retention area located along the eastern border of lots 7 and 14. BMW is also seeking to replat lots 7 and 14 and the retention area designated on the Coastal Business Center plat, as recorded in Plat Book 15, Page 10, in the Public Records of Walton County, Florida. The site is at the end of Commercial Parkway off Goldsby Road, in the Coastal Business Center industrial subdivision (parcel numbers 30-2S-20-33500-000-0070; 000-0140 and 000-00A0).

5. FLORIDA TRANSFORMER MASTER PLAN EXPANSION – Project number 08-001-00044. This is a major development order application submitted by Chris Fountain, requesting approval of a Master Plan and Phase I, consisting of a 7,500 square foot industrial building and a gravel parking lot. Future phases will consist of a 7,500 square foot industrial building, two (2) 5,000 square foot industrial buildings, and a 2,000 square foot office building for a total of 27,000 square feet.  The project is on ±14.33 acres with a future land use of industrial. The site is on the west side of C.R. 83, south of Sunrise Road and north of Cordie Redmon Road (parcel numbers 02-3N-19-19000-010-0020, 02-3N-19-19000-010-0031, 02-3N-19-19000-015-0000, and 19-3N-19-19000-019-0000).

The Planning Commission will make a recommendation to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any agenda item that is tabled will be scheduled for a future Planning Commission meeting and will not go forward to the Board of County Commissioners until the Planning Commission makes a recommendation.

In accordance with Section 286.26, Florida Statutes, whenever any board or commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision, which has scheduled a meeting at which official acts are to be taken receives, at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting, directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.

Any person whose substantial interests are affected by any decision of the Department on the application has the right to request an administrative hearing in accordance with the provisions of Sections 120.569 and 120.57 of the Florida Statutes. Should you desire an administrative hearing, your request must comply with the provisions of Rule 28-106.201 of the Florida Administrative Code, as indicated below. When the Department receives an adequate and timely filed request for hearing, the Department will request the assignment of an administrative law judge. Rule 28-106.201(2), Florida Administrative Code, explains what must be included in a petition for a formal administrative proceeding. Section 120.54(5)(b)4, Florida Statutes, and Rule 28-106.201(2) of the Florida Administrative Code, explain what must be included in a petition for a formal administrative proceeding. Unless otherwise provided by statute, and except for agency enforcement and disciplinary actions that shall be initiated under rule 28-106.2015, F.A.C., initiation of proceedings shall be made by written petition to the agency responsible for rendering final agency action. The term “petition” includes any document that requests an evidentiary proceeding and asserts the existence of a disputed issue of material fact. Each petition shall be legible and on 8 1/2 by 11 inch white paper. Unless printed, the impression shall be on one side of the paper only and lines shall be double-spaced.

(a) The name and address of each agency affected and each agency’s file or identification number, if known;
(b) The name, address, and telephone number of the petitioner; the name, address, and telephone number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests will be affected by the agency determination;
(c) A statement of when and how the petitioner received notice of the Department’s action;
(d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate;
(e) A concise statement of ultimate facts alleged, including the specific facts the petitioner contends warrant reversal or modification of the Department’s proposed action;
(f) A statement of the specific rules or statute the petitioner contends require reversal or modification of the Department’s proposed action, including an explanation of how the alleged facts relate to the specific rules or statutes; and
(g) A statement of the relief sought by the petitioner, stating precisely the action petitioner wishes the Department to take with respect to the Department’s proposed action.

A person may request an extension of time to petition for an administrative hearing. The person filing the request for extension must do so within the time limits for filing a petition described above and serve all parties with the request. The request must state why an extension is needed. The Department will grant an extension only when good cause is shown.
If a petition or request for extension of time is filed, further order of the Department becomes necessary to effectuate this notice. Accordingly, the Department’s final action may be different from the position taken by it in this notice. Actions undertaken by you under this permit, pending the lapse of time allowed for the filing of such a request for hearing, may be subject to modification, removal, or restoration.
Failure to petition within the allowed time frame constitutes waiver of any right that such a person has to request a hearing under Sections 120.569 and 120.57 of the Florida Statutes and to participate as a party to the proceeding. If a legally sufficient petition for hearing is not timely received this notice constitutes final agency action. When this order becomes final, any party to the order has the right to seek judicial review under Section 120.68 of the Florida Statutes and Rules 9.03(b)(1) and 9.110 of the Florida Rules of Appellate Procedure by filing a notice of appeal with the Department of Environmental Protection, Office of General Counsel, Department Clerk, 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399, and with the appropriate district court of appeal within thirty days after this final order is filed with the Department Clerk. The notice filed with the district court must be accompanied by the filing fee specified in Section 35.22(3) of the Florida Statutes. Any subsequent intervention will only be at the approval of the presiding officer upon motion filed under Rule 28-106.205, Florida Administrative Code.
A person whose substantial interests are affected by the Department’s proposed agency action may choose to pursue mediation as an alternative remedy under Section 120.573 before the deadline for filing a petition. Choosing mediation will not adversely affect the right to a hearing if mediation does not result in a settlement. The procedures for pursuing mediation are set forth below.
A person may pursue mediation by reaching a mediation agreement with all parties to the proceeding (which include the applicant, the Department, and any person who has filed a timely and sufficient petition for a hearing) and by showing how the substantial interests of each mediating party are affected by the Department’s action or proposed action. The agreement must be filed in (received by) the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, by the same deadline as set forth above for the filing of a petition.
The agreement to mediate must include the following:
(a) The names, addresses, and telephone numbers of any persons who may attend the mediation;
(b) The name, address, and telephone number of the mediator selected by the parties, or a provision for selecting a mediator within a specified time;
(c) The agreed allocation of the costs and fees associated with the mediation;
(d) The agreement of the parties on the confidentiality of discussions and documents introduced during mediation;
(e) The date, time, and place of the first mediation session, or a deadline for holding the first session, if no mediator has yet been chosen;
(f) The name of each party’s representative who shall have the authority to settle or recommend settlement, and
(g) Either an explanation of how the substantial interests of each mediating party will be affected by the action or proposed action addressed in this notice of intent or a statement clearly identifying the petition for hearing that each party has already filed, and incorporating it by reference.
(h) The signatures of all parties or their authorized representative.
As provided in Section 120.573 of the Florida Statutes, the timely agreement of all parties to mediate will toll the time limitations imposed by Sections 120.569 and 120.57 for requesting and holding an administrative hearing. Unless otherwise agreed by the parties, the mediation must be concluded within sixty days of the execution of the agreement. If mediation results in settlement of the administrative dispute, the Department must enter a final order incorporating the agreement of the parties. Persons whose substantial interest will be affected by such a modified final decision of the Department have a right to petition for a hearing only in accordance with the requirements for such set forth above, and must therefore file their petitions within twenty-one days of receipt of this notice. If mediation terminates without settlement of the dispute, the Department shall notify all parties in writing that the administrative hearing processes under Sections 120.569 and 120.57 remain available for disposition of the dispute, and the notice will specify the deadlines that then will apply for challenging the agency action and electing remedies under those two statutes.

The Department gives notice of its intent to find the Amendment to the Comprehensive Plan for City of Freeport, adopted by Ordinance No. 08-08 on September 25, 2008, IN COMPLIANCE, pursuant to Sections 163.3184, 163.3187 and 163.3189, F.S.

If a petition is filed, other affected persons may petition for leave to intervene in the proceeding. A petition for intervention must be filed at least twenty (20) days before the final hearing and must include all of the information and contents described in Uniform Rule 28-106.205, F.A.C. A petition for leave to intervene shall be filed at the Division of Administrative Hearings, Department of Management Services, 1230 Apalachee Parkway, Tallahassee, Florida 32399-3060. Failure to petition to intervene within the allowed time frame constitutes a waiver of any right such a person has to request a hearing under Sections 120.569 and 120.57, F.S., or to participate in the administrative hearing.

The choice of mediation shall not affect a party’s right to an administrative hearing.

MANAGEMENT DISTRICT GIVES
NOTICE OF PROPOSED AGENCY ACTION
The District gives notice of its intent to issue a stormwater permit to F. Lloyd Blue Jr., President, BEP Investments, LLC, d/b/a Emerald Glenn, BEP Developers, Inc., on December 11, 2008.

The project is located approximately 8 miles east of US Highway 331 on north side of C.R. 3280 near Freeport in Walton County. The permit authorizes the construction of wet detention, dry retention, and stormwater conveyance systems serving an 800 ± acre residential/equestrian community comprised of 136 four acre lots, associated roadway and the future village areas within this phase.

The files containing the application for the above listed permit is available for inspection Monday through Friday (except for legal holidays), 8:00 a.m. to 5:00 p.m. at the Northwest Florida Water Management District Crestview Field Office, 800 Hospital Drive, Crestview, FL 32539. A petition for an administrative hearing is deemed filed upon receipt of the complete petition by the District Clerk at the District Headquarters in Havana, Florida. Petitions received by the District Clerk after 5:00 p.m., or on a Saturday, Sunday, or legal holiday, shall be deemed filed as of 8:00 a.m. on the next regular District business day. The District’s acceptance of petitions filed by email is subject to certain conditions set forth in the District’s Statement of Agency Organization and Operation (issued pursuant to Rule 28-101.001, Florida Administrative Code), which is available for viewing at www.nwfwmd.state.fl.us. These conditions include, but are not limited to, the petition being in the form of a PDF file and being capable of being stored and printed by the District. Further, pursuant to the District’s Statement of Agency Organization and Operation, attempting to file a petition by facsimile is prohibited and shall not constitute filing.

Failure to file a petition for an administrative hearing within the requisite time frame shall constitute a waiver of the right to an administrative hearing. (Rule 28-106.111, F.A.C.).

The right to an administrative hearing and the relevant procedures to be followed are governed by Chapter 120, Florida Statutes, Chapter 28-106, F.A.C. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means the District’s final action may be different from the position taken by it in this notice. A person whose substantial interests are or may be affected by the District’s final action has the right to become a party to the proceeding, in accordance with the requirements set forth above.
