Project overview: A new community enhancement project has been designed to improve and showcase a considerable portion of Emerald Coast Parkway in South Walton County. The Beautification Project will landscape approximately 2 miles of medians on Emerald Coast Parkway from Mack Bayou Road east to CR 30-A, creating a beautifully scenic focal point and continued source of pride for the entire community.

The Beautification Project is the latest initiative undertaken by the Scenic Corridor Association in an effort to continue their mission to preserve and protect the character of Emerald Coast Parkway in South Walton County. Founded in 1994, the organization is dedicated to the preservation and enhancement of the scenic nature and unique qualities of South Walton County in an effort to foster an environment of excellence that benefits citizens, businesses and visitors in our area. The landscaping of this particular stretch of roadway is the beginning of a longer term initiative by the Scenic Corridor Association to beautify the medians along Emerald Coast Parkway throughout Walton County.

Bill Smith, RLA, is a landscape architect and urban planner with Kimley-Horn’s office in Grand Boulevard at Sandestin®. He is the landscape architect for the project and describes the design concept for the medians as a “patterned and rhythmic green belt”. The variety of foliage will include Crape Myrtles, Saw Palmetto, Muhly Grass, Plumbago, and improvements to the sod.

SCHOOL BOARD OF
WALTON COUNTY, FLORIDA,
TO ADOPT A POLICY RELATED TO BULLYING AND HARASSMENT

The School Board of Walton County, Florida, hereby gives notice of its intent to adopt a proposed new policy, Bullying and Harassment, which by reference is incorporated as part of School Board Rules, pursuant to the procedures set forth in the Administrative Procedures Act.

PURPOSE AND EFFECT: The purpose and effect of the adoption of the Bullying and Harassment policy is to present to school personnel, parents/guardians, students and other interested citizens the administrative procedures required to implement state legislative and local policy requirements.
SUMMARY: The Bullying and Harassment Policy being proposed fulfills the requirements of s. 1006.147, F.S., The Jeffery Johnston Stand Up for All Students Act. The policy under consideration is the model policy prepared by the Florida Department of Education.

LEGAL AUTHORITY: The adoption of the Bullying and Harassment Policy is authorized by Section 1001.41, 1001.42, 1006.08, 1008.25, 1008.34, 1001.03, and 1008.22, Florida Statutes, and the law implemented is Section, 1001.43, 1003.04, 1003.31, 1003.32, 1006.07, 1006.08, 1006.09, 1006.10, 1006.147 Florida Statutes.

ECONOMIC IMPACT: The adoption of the Bullying and Harassment policy will not result in any additional costs to the School District.
A public hearing will be held by the School Board of Walton County, Florida, at 5:15 p.m. during the regular board meeting on November 18, 2008 in the Board Room at the Tivoli Administrative Complex, 145 Park Street, DeFuniak Springs, Florida, for the purpose of considering adoption of the Bullying and Harassment policy. Any interested person may appear at the hearing and present evidence and argument and be heard concerning the adoption of the Bullying and Harassment policy. Immediately following the public hearing the School Board of Walton County, Florida will consider final action to adopt the Bullying and Harassment policy.

The entire text of the Bullying and Harassment policy is on file and available for inspection during regular office hours at the office of the Superintendent of Schools, Walton County, Florida, located at 145 Park Street, Suite 2 DeFuniak Springs, Florida. The proposed rule can also be found on the district’s website: www.walton.k12.fl.us.

If a person decides to appeal any decision made by the School Board with respect to any matter considered at such meeting or hearing, such person will need a record of the proceedings, and for such purpose, such person may need to ensure that verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.

This is a major development order application submitted by P & B Management requesting conceptual approval of a mixed-use development consisting of 658 single family lots, 12 multi family units, and 265,000 square feet of commercial space on 1,051.66 acres with a future land use of NBNPA/rural town center and large scale agricultural. The site is on the north & south side of CR 3280, near the intersection of Magnolia Lodge Road (parcel numbers 05-2S-18-15000-002-0000, 04-2S-18-15000-001-0000, and 04-2S-18-15000-001-0010.)

2. D & H SAND PIT SPECIAL EXCEPTION – Project number 08-017-00001. This is a special exception application submitted by Emerald Coast Associates, requesting approval of a sand mine on 121.7 acres with a future land use of large scale agriculture. The site is at 760 Sand Plant Road, off Rock Hill Road (parcel number 18-2N-17-05000-004-0020).

3. ORANGE STREET ABANDONMENT – Project number 08-008-00003. This is an abandonment application submitted by Dean Burgis, requesting the abandonment of an east/west 33-foot easement beginning on the east side of South Orange Street and traveling across the south side of government lots 146 and 147 and the north side of government lot 175 in the Inlet Beach area along the southern side of US Hwy 98 and east of South Orange Street (parcel numbers 36-3S-18-16100-000-1460, 36-3S-18-16100-000-1470, and 36-3S-18-16700-000-0000).

4. PLANTATION SUBDIVISION DEEDED EASEMENT ABANDONMENT – Project number 08-008-00004. This is an abandonment application submitted by Walton County. The Plantation deeded easement abandonment consists of an abandonment of the 50-foot easement on either side of the centerline of the platted roads within Plantation Subdivision recorded in 1978.  The deeded easement is in OR Book 203, page 562, over the 50-foot platted roads in the Plantations Subdivision, per Plat Book 5, Page 22-22a.  This abandonment serves to correct the typographical error, which should have read a 25-foot easement on either side of the centerline of the platted roads within Plantation Subdivision to comprise a 50-foot easement.

5. ALYS BEACH PUD AMENDMENT – Project number 08-001-00053. This is a major development order application submitted by Moore Bass Consulting, requesting an amendment to a previously approved planned unit development. This amendment will increase the number of residential units by 300 and the amount of retail by 10,000 square feet on +/- 158.49 acres with a future land use of NPA/TND. The site is approximately 1 mile west of the eastern intersection of U.S. 98 and C.R. 30A (parcel numbers 27-3S-18-16000-027-0010 & 26-3S-18-16000-003-0000).

6. WALTON COUNTY APARTMENTS PUD – Project number 08-001-00055. This is a major development order application submitted by Connelly & Wicker, Inc., requesting conceptual approval of 261 multifamily rental units within 9 buildings and 9,800 square feet for office/bank use on 46.27 +/- acres with a future land use of small neighborhood. The site is on the east side of U.S. 331, approximately 1,600 feet south of Chat Holly Road (parcel numbers 29-2S-19-24000-004-0000 and 29-2S-19-24000-008-0000).

7. GLENDALE PRESBYTERIAN CHURCH – Project number 08-001-00054. This is a major development order application submitted by Johnson Surveying, LLC, requesting approval to relocate an existing 1,634 square foot church building to, and build a 15,200 square feet new building on 28.25 acres with a future land use of general agriculture. The site is at the northwest corner of the intersection of Highway 83 North and C.R. 1084 in Glendale (parcel number 14-4N-19-20000-007-0020).

The Walton County Design Review Board will hold a regular public meeting to hear projects beginning at 5:00 p.m. on Thursday, November 6, 2008 at the South Walton County Courthouse Annex located at 31 Coastal Centre Boulevard, Santa Rosa Beach, Florida 32459.  The Board will hear the following items:
1. TOPS’L COMMERCIAL CENTER MASTER SIGNAGE PLAN – Project number 08-001-00049. This is a sign permit application submitted by Boardwalk Designs, requesting approval of a master signage plan. The site is at 8955 U.S. Highway 98 West (parcel number 35-2S-21-42100-000-0010).

2. GOODWILL BUILDING SIGN – Project number 08-001-00056. This is a sign permit application submitted by Bell Signs, requesting approval of a building sign measuring 3’10” x 20’ for a total of 76.66 square feet. The site is at 3223 U.S. Highway 98 West (parcel number 34-2S-20-33270-001-0003).

SPECIAL WORKSHOP: THE BOARD WILL CONDUCT A WORKSHOP TO LOOK AT VARIOUS OPTIONS FOR OFF-PREMISE SIGNAGE AND COMMUNITY DIRECTORY SIGNS ALONG THE U.S. HIGHWAY 98 SCENIC CORRIDOR. OPTIONS TO BE DISCUSSED INCLUDE THE CURRENT WHITE COMMUNITY DIRECTORY SIGNS IN USE AT INTERSECTIONS WITH U.S. 98, THE POSSIBLE USE OF THE TDC BLUE SIGNS THAT WERE ORIGINALLY PURCHASED FOR C.R. 30A BUT WERE REJECTED AS INCOMPATIBLE FOR USE ALONG THAT CORRIDOR, AS WELL AS ANY OTHER SUGGESTED SOLUTIONS.

The Design Review Board will make a recommendation on major developments to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any item that is tabled will be scheduled for a future Design Review Board meeting and will not go forward to the Planning Commission until the Design Review Board makes a recommendation.

The development will include up to 55,000 square feet of youth recreational, educational, and community support center, and up to 10,000 square feet of pool and pool deck area. The Boys and Girls Club will share parking with the Walton County Coastal Branch Library, will share a joint stormwater facility with adjoining properties, and will dedicate right-of-way for a future public road. The site is located at 427 Greenway Trail, behind the Walton County Coastal Branch Library (parcel numbers 30-2S-19-24000-019-0000 and 30-2S-19-24000-020-0000).

LEGISLATIVE ITEMS:

2. C.R. 30A SCENIC CORRIDOR ORDINANCE – An ordinance amending Chapter 13 of the Walton County Land Development Code to add Churchill Bayou Road, Chat Holly Road, and South Church Street to the C.R. 30-A scenic corridor; providing severability; and providing an effective date.

3. SIDEWALK ORDINANCE – An ordinance amending Walton County Land Development Code §5.04.03h to allow the County Engineer discretion to waive the construction of sidewalks and/or a contribution to the sidewalk fund for sidewalks in rural areas; providing for severability, providing for conflict, and providing an effective date.

The site is at the northeast corner of U.S. 98 and C.R. 30A (parcel numbers 29-2S-20-33000-045-0000, 29-2S-20-33000-046-0011, 29-2S-20-33000-046-0020, 29-2S-20-33000-046-0030, 29-2S-20-33000-046-0060, and 29-2S-20-33000-046-0070).

7. TOWN CENTER AT BLACK CREEK PUD AMENDMENT – Project number 08-001-00052. This is a major development order application submitted by P & B Management requesting conceptual approval of a mixed-use development consisting of 658 single family lots, 12 multi family units, and 265,000 square feet of commercial space on 1,051.66 acres with a future land use of NBNPA/rural town center and large scale agricultural. The site is on the north & south side of CR 3280, near the intersection of Magnolia Lodge Road (parcel numbers 05-2S-18-15000-002-0000, 04-2S-18-15000-001-0000, and 04-2S-18-15000-001-0010.)

The Planning Commission will make a recommendation to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any agenda item that is tabled will be scheduled for a future Planning Commission meeting and will not go forward to the Board of County Commissioners until the Planning Commission makes a recommendation.

The Department issues this cumulative notice of intent to find the City of Freeport Comprehensive Plan Amendment adopted by Ordinance No(s). 08-1 on March 11, 2008 and the remedial amendment(s) adopted by Ordinance 08-05 on August 28, 2008 IN COMPLIANCE, pursuant to Sections 163.3184, 163.3187 and 163.3189, F.S.

The adopted City of Freeport Comprehensive Plan Amendment and the Department’s Objections, Recommendations, and Comments Report, (if any), are available for public inspection Monday through Friday, except for legal holidays, during normal business hours, at the City of Freeport Clerks Office, 112 Highway 20 West, Freeport, Florida 32439.

Any affected person, as defined in Section 163.3184, F.S., has a right to petition for an administrative hearing to challenge the proposed agency determination that the Remedial Amendments are In Compliance, as defined in Subsection 163.3184(1), F.S. The petition must be filed within twenty one (21) days after publication of this notice, and must include all of the information and contents described in Uniform Rule 28-106.201, F.A.C. The petition must be filed with the Agency Clerk, Department of Community Affairs, 2555 Shumard Oak Boulevard, Tallahassee, Florida 32399-2100 and a copy mailed or delivered to the local government. Failure to timely file a petition shall constitute a waiver of any right to request an administrative proceeding as a petitioner under Sections 120.569 and 120.57, F.S. If a petition is filed, the purpose of the administrative hearing will be to present evidence and testimony and forward a recommended order to the Department. If no petition is filed, this Notice of Intent shall become final agency action.

If a petition is filed, other affected persons may petition for leave to intervene in the proceeding. A petition for intervention must be filed at least twenty (20) days before the final hearing and must include all of the information and contents described in Uniform Rule 28 106.205, F.A.C. A petition for leave to intervene shall be filed at the Division of Administrative Hearings, Department of Administration, 1230 Apalachee Parkway, Tallahassee, Florida 32399 3060. Failure to petition to intervene within the allowed time frame constitutes a waiver of any right such a person has to request a hearing under Sections 120.569 and 120.57, F.S., or to participate in the administrative hearing.

After an administrative hearing petition is timely filed, mediation is available pursuant to Subsection 163.3189(3)(a), F.S., to any affected person who is made a party to the proceeding by filing that request with the administrative law judge assigned by the Division of Administrative Hearings. The choice of mediation shall not affect a party’s right to an administrative hearing.

PUBLIC WORKSHOP

The Walton County Planning Commission will hold a public meeting to hear the following items on Wednesday, November 5, 2008, beginning at 9:00 a.m. at the South Walton County Courthouse Annex located at 31 Coastal Centre Boulevard, Santa Rosa Beach, Florida 32459:

LEGISLATIVE ITEMS:

A workshop to consider the EAR-based amendments to the Walton County Comprehensive Plan, beginning with the Future Land Use Element. This is a continuation from Monday, October 27, 2008.

The Planning Commission will make a recommendation to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any agenda item that is tabled will be scheduled for a future Planning Commission meeting and will not go forward to the Board of County Commissioners until the Planning Commission makes a recommendation.

In accordance with Section 286.26, Florida Statutes, whenever any board or commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision, which has scheduled a meeting at which official acts are to be taken receives, at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting, directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.
