Project overview: A new community enhancement project has been designed to improve and showcase a considerable portion of Emerald Coast Parkway in South Walton County. The Beautification Project will landscape approximately 2 miles of medians on Emerald Coast Parkway from Mack Bayou Road east to CR 30-A, creating a beautifully scenic focal point and continued source of pride for the entire community.

The Beautification Project is the latest initiative undertaken by the Scenic Corridor Association in an effort to continue their mission to preserve and protect the character of Emerald Coast Parkway in South Walton County. Founded in 1994, the organization is dedicated to the preservation and enhancement of the scenic nature and unique qualities of South Walton County in an effort to foster an environment of excellence that benefits citizens, businesses and visitors in our area. The landscaping of this particular stretch of roadway is the beginning of a longer term initiative by the Scenic Corridor Association to beautify the medians along Emerald Coast Parkway throughout Walton County.

Bill Smith, RLA, is a landscape architect and urban planner with Kimley-Horn’s office in Grand Boulevard at Sandestin®. He is the landscape architect for the project and describes the design concept for the medians as a “patterned and rhythmic green belt”. The variety of foliage will include Crape Myrtles, Saw Palmetto, Muhly Grass, Plumbago, and improvements to the sod.

TO ADOPT A POLICY RELATED TO BULLYING AND HARASSMENT

The School Board of Walton County, Florida, hereby gives notice of its intent to adopt a proposed new policy, Bullying and Harassment, which by reference is incorporated as part of School Board Rules, pursuant to the procedures set forth in the Administrative Procedures Act.

PURPOSE AND EFFECT: The purpose and effect of the adoption of the Bullying and Harassment policy is to present to school personnel, parents/guardians, students and other interested citizens the administrative procedures required to implement state legislative and local policy requirements.
SUMMARY: The Bullying and Harassment Policy being proposed fulfills the requirements of s. 1006.147, F.S., The Jeffery Johnston Stand Up for All Students Act. The policy under consideration is the model policy prepared by the Florida Department of Education.

LEGAL AUTHORITY: The adoption of the Bullying and Harassment Policy is authorized by Section 1001.41, 1001.42, 1006.08, 1008.25, 1008.34, 1001.03, and 1008.22, Florida Statutes, and the law implemented is Section, 1001.43, 1003.04, 1003.31, 1003.32, 1006.07, 1006.08, 1006.09, 1006.10, 1006.147 Florida Statutes.

ECONOMIC IMPACT: The adoption of the Bullying and Harassment policy will not result in any additional costs to the School District.
A public hearing will be held by the School Board of Walton County, Florida, at 5:15 p.m. during the regular board meeting on November 18, 2008 in the Board Room at the Tivoli Administrative Complex, 145 Park Street, DeFuniak Springs, Florida, for the purpose of considering adoption of the Bullying and Harassment policy. Any interested person may appear at the hearing and present evidence and argument and be heard concerning the adoption of the Bullying and Harassment policy. Immediately following the public hearing the School Board of Walton County, Florida will consider final action to adopt the Bullying and Harassment policy.

The entire text of the Bullying and Harassment policy is on file and available for inspection during regular office hours at the office of the Superintendent of Schools, Walton County, Florida, located at 145 Park Street, Suite 2 DeFuniak Springs, Florida. The proposed rule can also be found on the district’s website: www.walton.k12.fl.us.

If a person decides to appeal any decision made by the School Board with respect to any matter considered at such meeting or hearing, such person will need a record of the proceedings, and for such purpose, such person may need to ensure that verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.

The School Board of Walton County does not discriminate upon the basis of any individual’s disability status. The Walton County School Board is seeking bids to furnish all materials and labor necessary for the Closure of the existing diesel fuel system and the installation of a new diesel fueling system.

1. TOPS’L COMMERCIAL CENTER MASTER SIGNAGE PLAN – Project number 08-001-00049. This is a sign permit application submitted by Boardwalk Designs, requesting approval of a master signage plan. The site is at 8955 U.S. Highway 98 West (parcel number 35-2S-21-42100-000-0010).

The Design Review Board will make a recommendation on major developments to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any item that is tabled will be scheduled for a future Design Review Board meeting and will not go forward to the Planning Commission until the Design Review Board makes a recommendation.

The Department of Environmental Protection gives notice of its intent to issue a permit to Mossy Head Water Works to construct public water system improvements. The proposed improvements would consist of constructing approximately 28 miles of 6-, 8-, 10-, and 12-inch PVC water main, including valves, fittings, hydrants, and appurtenances. Additionally, the project would include construction of a new 200,000-gallon elevated potable water storage tank at the site of existing Well No. 2 on the west side of New Harmony Road (County Road 1087) just south of the New Harmony Road and Adams Road intersection in Walton County, Florida.

The intent to issue and application file are available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at the Florida Department of Environmental Protection, 160 Governmental Center, Pensacola, Florida, 32502-5794.

The Department will issue the permit with the attached conditions unless a timely petition for an administrative hearing is filed under Sections 120.569 and 120.57, Florida Statutes, within fourteen days of receipt of notice. The procedures for petitioning for a hearing are set forth below.

A person whose substantial interests are affected by the Department’s proposed permitting decision may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57, Florida Statutes. The petition must contain the information set forth below and must be filed (received by the clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000.

Under Rule 62-110.106(4), Florida Administrative Code, a person may request enlargement of the time for filing a petition for an administrative hearing. The request must be filed (received by the clerk) in the Office of General Counsel before the end of the time period for filing a petition for an administrative hearing.

Petitions filed by any persons other than those entitled to written notice under Section 120.60(3), Florida Statutes, must be filed within fourteen days of publication of the notice or within fourteen days of receipt of the written notice, whichever occurs first Under Section 120.60(3), Florida Statutes, however, any person who has asked the Department for notice of agency action may file a petition within fourteen days of receipt of such notice, regardless of the date of publication.

The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing. The failure of any person to file a petition or request for enlargement of time within fourteen days of receipt of notice shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, Florida Statutes. Any subsequent intervention (in a proceeding initiated by another party) will be only at the discretion of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, Florida Administrative Code.

A petition that disputes the material facts on which the Department’s action is based must contain the following information:
(a) The name, address, and telephone number of each petitioner, the name, address, and telephone number of the petitioner’s representative, if any; the Department permit identification number and the county in which the subject matter or activity is located;
(b) A statement of how and when each petitioner received notice of the Department action;
(c) A statement of how each petitioner’s substantial interests are affected by the Department’s action;
(d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate;
(e) A statement of facts that the petitioner contends warrant reversal or modification of the Department’s action;
(f) A concise statement of the ultimate facts alleged, as well as the rules and statutes which entitle the petitioner to relief; and
(g) A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wants the Department to take.

Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Department’s final action may be different from the position taken by it in this notice. The Walton County School Board is seeking bids for the replacement of a 245-ton chiller at Freeport Elementary School, Freeport FL. Bid shall include all materials, parts and labor to remove and replace existing chiller and make replacement functional with the on site HVAC equipment, controls etc. The duration of this bid is for two years with an option to renew for an additional year at the same terms upon mutual consent with successful bidder.

Bid specifications can be obtained from the Office of Administration and Operations, Walton County School District, 145 Park Street, Suite 2, DeFuniak Springs, FL 32435.

All bids shall be sealed in an envelope marked “BID ON WATER COOLED CHILLER”. Bids shall be submitted to the Office of the Superintendent of Schools, Walton County School District, 145 Park Street, DeFuniak Springs, FL 32435, no later than 2:00 p.m. on November 12, 2008, at which time the bids shall be opened by the Bid Committee. Bids will be awarded by the School Board at its next regular meeting. The successful bidder will be notified within ten (10) working days following the acceptance of this bid. The Walton County School Board shall have the right to reject any or all bids and shall have the right to award bids in the manner in which the Board determines to be in its best interest. Notice is hereby given that Walton County has received a request from Silver Sands J.V.P. for an Amended and Restated Development Order regarding the Silver Sands Development of Regional Impact (“DRI”). The original Silver Sands DRI Development Order was approved by Walton County Resolution No. 98-64, which was adopted on October 27, 1998. This development is located at 19562 West Emerald Coast Highway in south Walton County, Florida.

The purpose of the Amended and Restated Development Order is to correct a scrivener’s error that currently shows an inconsistency between the text of the Development Order and a map attachment; update references that are outdated; and extend the phase, buildout and termination dates by three years pursuant to Section 380.06(19)(c), Florida Statutes.
