NOTICE IS HEREBY GIVEN that by Order dated April 12, 2010  (“Confirmation Order”), the Bankruptcy Court confirmed Whitney National Bank’s First Amended Plan of Reorganization dated October 13, 2009 (the “Plan”), which provides for the sale by auction (the “Auction”) by the Court-appointed Liquidating Trustee, Tom Risalvato, CPA (the “Liquidating Trustee”) of substantially all assets (the “Acquired Assets”) of the Debtor, Barefoot Cottages Development Company, LLC (the “Debtor”) remaining after eighteen (18) months from the May 12, 2009 Effective Date of the Plan.

(a) in accordance with the Plan and Confirmation Order, the Liquidating Trustee shall conduct the Auction, after which the Liquidating Trustee Will determine the prevailing bidder for the Acquired Assets (the “Prevailing Bidder”). The Auction will be held on January 10, 2012 at 10:00 a.m. at the offices of Carr, Riggs & Ingram, 151 Mary Esther Boulevard, Suite 301, Mary Esther, Florida 32569.

(b) All bidders must register and have deposit funds (the “Deposit”) available before the Auction begins. The Deposit must be made prior to the Auction in the form of
an electronic check (ACH), wire transfer, cash, or certified check. To be qualified to bid, all bidders except for Biel REO, LLC or its designee, as successor-in-interest to Whitney National Bank, shall be required to Deposit with the Liquidating Trustee a sum not less than ten percent (10%) of the bidder’s planned maximum bid. Bidders Will not be permitted to bid in excess of the planned maximum bid, as determined by the Deposit, without first providing an additional deposit to the Liquidating Trustee.

(C) the Prevailing Bidder shall make payment in full by the close of business on the date of the Auction. Acceptable forms of payment are wire transfers and certified check made payable to Barefoot Cottages Development Company, LLC Debtor in Possession. If payment is not made within this timeframe, the Liquidating Trustee may cancel the highest bid, re–advertise the Auction and pay all costs of the Auction from the deposit. Any remaining funds in the Deposit shall be held by the Liquidating Trustee and distributed to the Class 4 Creditor under the Plan.

NOTICE OF PUBLIC HEARING

The Walton County Design Review Board will hold a regular public meeting to hear projects beginning at 5:00 p.m. on Thursday, January 5, 2012 at the South Walton County Courthouse Annex located at 31 Coastal Centre Boulevard, Santa Rosa Beach, Florida 32459.  The Board will hear the following items:

1. BODACIOUS CONSIGNMENT & DESIGN – Project Number 11-001-00038 This is a sign application submitted by A World of Signs, requesting approval for a building sign measuring 36 inches x 163 inches for a total of 40.75 square feet and a monument sign measuring 8.0 feet X 10.0 feet for a total of 80 square feet.  The site is at 13381-A U.S. Highway 98 West (parcel number 29-2S-21-42100-000-0010).

The Design Review Board will make a recommendation on major developments to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any item that is tabled will be scheduled for a future Design Review Board meeting and will not go forward to the Planning Commission until the Design Review Board makes a recommendation.  In matters regarding deviations from the Scenic Corridor guidelines, as adopted in Section 13 of the Walton County Land Development Code, the decision by the Design Review Board are final decisions.  Pursuant to Section 9.06.06 of the Walton County Land Development Code, any decision or determination of the Board which is contested by an applicant with regard to application or interpretation of the standards shall be referred to the Board of Adjustment for appeal hearing.

In accordance with Section 286.26, Florida Statutes, whenever any board or commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision, which has scheduled a meeting at which official acts are to be taken receives, at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting, directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.

In accordance with Section 286.0105, Florida Statutes, all persons are advised that, if a person decides to appeal any decision made by the board, agency, or commission with respect to any matter considered at such meeting or hearing, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
