PUBLIC HEARING NOTICE

The Walton County Technical Review Committee will hold a public hearing on Wednesday, September 3, 2008 at 8:30 am at the South Walton Courthouse Annex in Santa Rosa Beach, FL 32459. The following items are scheduled for review and action:
1. FLORIDA TRANSFORMER MASTER PLAN EXPANSION – Project number 08-001-00044. This is a major development order application submitted by Chris Fountain, consisting of a Master Plan and Phase I approval for a 25,000 square foot building expansion on 14.33 acres with a future land use of industrial. The site is on Highway 83 North, south of Sunrise Road (parcel numbers 02-3N-19-19000-010-0020, 02-3N-19-19000-010-0030, 02-3N-19-19000-015-0000, and 02-3N-19-19000-019-0000).

2. WILDWOOD LAKES PHASE III PLAT – Project number 08-003-00015. This is a final plat application submitted by William Chandler, requesting approval of 34 single-family lots on 67.52 acres with a future land use of rural village. The site is at 477 Bearhead Road (parcel number 23-3N-20-28000-001-0000).

3. EAGLE BAY PHASE II FIRST ADDITION PLAT – Project number 08-003-00009. This is a replat application submitted by Emerald Coast Associates, Inc. The applicant proposes to replat Lot 1, Block J, a portion of the adjacent common area, and a portion of Bald Eagle Drive into 6 townhomes and one single family lot on .47 acres with a future land use of TND. The site is located on the west side of East Hewitt Road, north of Topsail Drive (parcel number 19-2S-20-33142-00J-0010).

4. SEASCAPE TOWN CENTER – Project number 08-001-00043. This is a minor development order application submitted by Wilson Miller, Inc. consisting of 43,692 square feet of commercial/retail/restaurant on 8.43 acres with a future land use of coastal center. This project is a phase of the Seascape Development of Regional Impact. Project is on the south side of U.S. 98, 4,400 feet east of Holiday Road (parcel number 29-2S-21-42500-000-0000).

5. ASSISI VILLAS AMENDMENT TO CONCEPTUAL PUD – Project number 08-001-00046. This is a minor development order application submitted by Darrell Barnhill, requesting an amendment to the previously approved conceptual PUD. The application seeks to increase the approved density from 10 units to 48 units, including 12 units of workforce housing. The amendment to the conceptual PUD is contingent upon the approval of a small scale future land use map amendment changing the land use from conservation residential 2:1 to small neighborhood. The site is 5.07 acres and is on the east side of Thompson Road, approximately 1,500 feet south of U.S. 98 (parcel numbers 34-2S-20-33270-060-0001 and 34-2S-20-33270-060-0002).

In accordance with Section 286.26, Florida Statutes, whenever any board of commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision, which has scheduled a meeting at which official acts are to be taken receives, at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.

In accordance with Section 286.0105, Florida Statutes, all persons are advised that, if a person decides to appeal any decision made by the board, agency, or commission with respect to any matter considered at such meeting or hearing, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.

NOTICE OF PUBLIC HEARING

The Walton County Design Review Board will hold a regular public meeting to hear projects beginning at 5:00 p.m. on Thursday, September 4, 2008 at the South Walton County Courthouse Annex located at 31 Coastal Centre Boulevard, Santa Rosa Beach, Florida 32459.  The Board will hear the following items:

1. HOLIDAY PLAZA ROOF COLOR DEVIATION – Project number 08-005-00007. This is a request for deviation from Section 13.02.03.3 of the land development code submitted by Porterfield Engineering. The applicant is requesting a deviation to allow a darker roof color than the approved spectrum. The site is at 12273 West Emerald Coast Parkway (parcel number 29-2S-21-42170-000-00A0).

2. RESORT RESALE BUILDING SIGN – Project number 08-001-00045. This is a sign permit application submitted by Himes Signs, requesting approval of a building sign measuring 18” x 15’4” for a total of 23 square feet. The site is at 3834 U.S. Highway 98 East (parcel number 27-2S-20-33630-000-00F0).

The Design Review Board will make a recommendation on major developments to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any item that is tabled will be scheduled for a future Design Review Board meeting and will not go forward to the Planning Commission until the Design Review Board makes a recommendation.

The Department of Homeland Security’s Federal Emergency Management Agency has issued a preliminary Flood Insurance Study (FIS) and Flood Insurance Rate Map (FIRM) reflecting new or modified Base (1% annual chance) Flood Elevations (BFEs) within the Cities of DeFuniak Springs and Freeport and the unincorporated areas of Walton County. Technical information or comments are solicited on the proposed and proposed modified BFEs shown on the preliminary FIS and FIRM for the aforementioned communities. These BFEs and modified BFEs are the basis for the floodplain management measures that your community is required to either adopt or show evidence of being already in effect in order to qualify or remain qualified for participation in the National Flood Insurance Program. REQUEST FOR PROPOSALS

The City of DeFuniak Springs is requesting financial funding proposals for two new knuckle boom loader trucks to be used in the city’s sanitation department. The cost of the new trucks is $192,000.

The City will accept bids until September 16, 2008 at 2:00 p.m. CST. The proposals will be opened in the Council Chambers on the above date and time and read aloud. The proposals shall be marked on the outside of the envelope “Sealed Bid – Financial Proposal for Trucks.” Sealed bids will be received at 71 US Hwy. 90 W., DeFuniak Springs, FL 32433 or P.O. Proposals should quote a simple interest rate with a term of five years. The financing can be a note payable or under a master lease program with the city maintaining title to the equipment. The rate quoted will be a fixed rate upon funding that can be locked for a period of at least thirty (30) days prior to the funding date. All closing cost for this loan should be included in the proposal and  these costs will be added to the lender’s charges when determining the lowest quote.

This is a major development order application submitted by Preble-Rish, Inc., consisting of the approval of a Master Plan and Phase I consisting of 55 RV units, a 1,500 square foot camp store, a 1,230 square foot laundry and shower facility, and a swimming pool with splash pad area. Future phases will consist of a 147.3 foot condominium having 73 units, restaurant, bakery/coffee shop, a 20 unit bed and breakfast, office, retail, and a 49 slip dock on 60.8 acres with a future land use of rural village. The parcel is located south of the Choctawhatchee Bay on the east side of Thompson Road, approximately 1,400 feet south of U.S. 98 (parcel numbers 34-2S-20-33270-060-0001 and 34-2S-20-33270-060-0002).

4. BLACK CREEK VILLAGE SSA 2008-14 – Black Creek Village Development, LLC is requesting a small scale amendment to change 10.0 +/- acres from large scale agriculture to NBNPA/Rural Town Center, or any less dense or intense category. The parcel is located north of the Choctawhatchee Bay on the south side of C.R. 3280, approximately 1.7 miles east of Magnolia Lodge Road (parcel number 10-2S-18-15000-001-0000).

5. SEASCAPE RESORT DRI NOPC – Project number 07-001-00029. This is a major development application submitted by Wilson Miller, Inc., requesting to amend the master plan for the Seascape DRI. The proposed changes include: 1) an increase in the height of the 3-story condominiums to 4 stories or 50 feet, whichever is less, resulting in increased open space and less impervious surface, but not increasing the number of approved condominium units; 2) an extension to the buildout date for the development to December 31, 2010, and an extension to the expiration date of the development order until December 31, 2023; 3) elimination of distinct project phases as they are no longer relevant or meaningful to the buildout of the project; and 4) revisions to the master plan to relocate residential and commercial areas within the Seascape property without increasing the number of residential units or the square feet of commercial space previously approved. The DRI is on approximately 256.34 acres with a future land use of coastal center, located on Scenic Gulf Drive (parcel number 29-2S-21-42500-000-0000).

6. SOMERBY PUD – Project number 08-001-00039. This is a major development order application submitted by Moore Bass Consulting, Inc., seeking conceptual approval for 112 garden-style condominiums, 120 independent living units, 48 assisted living units, 24 memory care units, and 18 units in freestanding duplexes and quad-plexes, totaling 322 residential units to be sold to individual owners. This project is 37.64 acres, which is variously designated as NPA/infill and small neighborhood. The site is on the east side of Mack Bayou Road, approximately 1 mile north of U.S. 98. (parcel numbers 25-2S-21-42000-027-0000, 25-2S-21-42350-000-0020, & 25-2S-21-42350-000-0090).

7. EMERALD COVE CONCEPTUAL PUD – Project number 07-001-00064. This is a major development order application submitted by Blue Mountain Partners, LLC, requesting conceptual approval for a planned unit development and technical approval of Phase 1, for 36 single-family homes on 18.31 acres with a future land use of CR-2:1. This subdivision will be developed in two phases. The project is located on the west side of Old Blue Mountain Road, north of U.S. 98 (parcel number 36-2S-20-33290-000-0010.)

8. BLACK CREEK PLANTATION PUD – Project number 06-001-00112. This is a major development order application for a conceptual planned unit development submitted by Ed Stanford, and Blackcreek Developers LLC, consisting of 652 single family units, 97 multi-family units, 60,000 square feet of commercial, 29,500 square feet of boat dry storage, as well as public and civic uses on 300 +/- acres with a future land use of NBNPA/RTC. The site is on the north side of Black Creek Road approximately 2 miles east of the Black Creek Boulevard and Black Creek Road intersection (parcel numbers 04-2S-18-15000-001-0030, 33-1S-18-14000-001-0030, 04-2S-18-15000-001-0020, 04-2S-18-15000-001-0040, and 04-2S-18-15000-001-0050).
The Planning Commission will make a recommendation to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any agenda item that is tabled will be scheduled for a future Planning Commission meeting and will not go forward to the Board of County Commissioners until the Planning Commission makes a recommendation.

NORTHWEST FLORIDA WATER
MANAGEMENT DISTRICT GIVES
NOTICE OF PROPOSED AGENCY ACTION
The District gives notice of its intent to issue a stormwater permit to Lee Perry, Azland Waste Services, LLC, of Freeport, on September 25, 2008.

The project is located approximately one-half mile east of U.S. 331 off Rock Hill Road near Freeport in Walton County, on tax parcel numbers 05-1N-18-08000-004-0000 and 06-1N-18-08000-004-0010. The permit would authorize the construction of a wet detention stormwater treatment system, discharging to two unnamed tributaries of Mill Creek. The treatment system will serve a 67.36+/- acre sand mine excavated in 5 acre cells, with restoration and re-vegetation of the excavated areas.

The files containing the application for the above listed permit is available for inspection Monday through Friday (except for legal holidays), 8:00 a.m. to 5:00 p.m. at the Northwest Florida Water Management District Crestview Field Office, 800 Hospital Drive, Crestview, FL 32539. The District will take action on the permit application listed above unless a petition for an administrative proceeding (hearing) is filed pursuant to the provisions of Sections 120.569 and 120.57, Florida Statutes Chapter 28-106 and 62-346.090(2)(j), Florida Administrative Code (F.A.C.).
A person whose substantial interests are or may be affected has the right to request an administrative hearing by filing a written petition with the Northwest Florida Water Management District (District). Pursuant to Chapter 28-106, F.A.C., the petition must be filed (received) either by delivery at District Headquarters, 81 Water Management Drive, Havana, FL 32333-4712 or by e-mail with the District Clerk at agency.clerk@nwfwmd.state.fl.us, within twenty-six (26) days of the District depositing notice of District decision in the mail (for those persons to whom the District mails actual notice), within twenty-one (21) days of the District emailing notice of District decision (for those persons to whom the District emails actual notice), or within twenty-one (21) days of newspaper publication of the notice of District decision (for those persons to whom the District does not mail or email actual notice). A petition must comply with Sections 120.54(5)(b)4. And 120.569(2)(c), Florida Statutes (F.S.), and Chapter 28-106, F.A.C. The District will not accept a petition sent by facsimile (fax), as explained below. Mediation pursuant to Section 120.573, F.S., is not available.

A person whose substantial interests are or may be affected has the right to a formal administrative hearing pursuant to Sections 120.569 and 120.57(1), F.S., where there is a dispute between the District and the party regarding an issue of material fact. A petition for formal hearing must also comply with the requirements set forth in Rule 28-106.201, F.A.C. A person whose substantial interests are or may be affected has the right to an informal administrative hearing pursuant to Sections 120.569 and 120.57(2), F.S., where no material facts are in dispute. A petition for an informal hearing must also comply with the requirements set forth in Rule 28-106.301, F.A.C.

A petition for an administrative hearing is deemed filed upon receipt of the complete petition by the District Clerk at the District Headquarters in Havana, Florida. Petitions received by the District Clerk after 5:00 p.m., or on a Saturday, Sunday, or legal holiday, shall be deemed filed as of 8:00 a.m. on the next regular District business day. The District’s acceptance of petitions filed by email is subject to certain conditions set forth in the District’s Statement of Agency Organization and Operation (issued pursuant to Rule 28-101.001, Florida Administrative Code), which is available for viewing at www.nwfwmd.state.fl.us. These conditions include, but are not limited to, the petition being in the form of a PDF file and being capable of being stored and printed by the District. Further, pursuant to the District’s Statement of Agency Organization and Operation, attempting to file a petition by facsimile is prohibited and shall not constitute filing.

Failure to file a petition for an administrative hearing within the requisite time frame shall constitute a waiver of the right to an administrative hearing. (Rule 28-106.111, F.A.C.).

The right to an administrative hearing and the relevant procedures to be followed are governed by Chapter 120, Florida Statutes, Chapter 28-106, F.A.C. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means the District’s final action may be different from the position taken by it in this notice. A person whose substantial interests are or may be affected by the District’s final action has the right to become a party to the proceeding, in accordance with the requirements set forth above.

REQUEST FOR BIDS

The City of DeFuniak Springs will accept sealed bids for an (AFC) Advanced Fuel Control System for small to mid-size fleet fueling applications for the city’s fleet maintenance fuel dept. The fuel control system must be easy to use, operator friendly, low maintenance and weather resistant. The AFC system will be a 2 hose key system with external remote modem, with 150 encoded keys, factory direct software training and 500 pulsers.
As an option the city would like to include 1 Durakey Encoder in the bid price.

INVITATION TO APPLY FOR 2008 VALUE ADJUSTMENT BOARD
SPECIAL MAGISTRATE
WALTON COUNTY, FLORIDA
The Value Adjustment Board of Walton County, Florida, invites all interested parties to submit Letters of Interest to serve as a Special Magistrate for the 2008 Value Adjustment Board.

No applicant may be an appointed or elected official or an employee of:
* Walton County, Florida
* A taxing jurisdiction; or
* The State of Florida.

A Special Magistrate appointed to hear issues of exemptions and classifications shall be a member of The Florida Bar with no less than 5 years experience in the area of ad valorem taxation.

A Special Magistrate appointed to hear issues regarding the valuation of real estate shall be a state certified estate appraiser with not less than 5 years experience in real property valuation.

Special Magistrates need not be a resident of Walton County. Special Magistrates may not represent taxpayer before the Board in any tax year during which he or she has served that Board as a Special Magistrate.

Hearing dates have been scheduled for October 16, 17, and 30, 2008. Dates are subject to change dependant upon petitions received.

Rate of pay shall be determined by the Value Adjustment Board. Applicants are asked to submit their proposed hourly rate with the Letter of Interest.

All interested parties shall submit their Letter of Interest with all qualifying documents, to this office no later than September 12, 2008 at 4:00 PM. Please make sure all qualifications, supporting documents, and work experience is documented in your Letter of Interest. Letters of Interest received after the deadline will not be eligible.
