The Walton County Code Enforcement board will hold their regular meeting on June 16, 2008 beginning at 6:00 p.m. to be held at the South Walton Courthouse Annex.

NOTICE OF INTENT OF THE SCHOOL BOARD OF
WALTON COUNTY TO AMEND BOARD POLICY

The School Board of Walton County, Florida, hereby gives notice of its intent to amend School Board Policy 6.13, Year of Service Defined for Administrative and Instructional Personnel.

PURPOSE, EFFECT & SUMMARY: The purpose and effect of the amendment is to no longer give instructors for pay purposes credit for years for which they are currently drawing retirement dollars. This amendment will not affect current employees

LEGAL AUTHORITY: FS 1001.41; FS 1001.42; FS 1001.43 & FS 1012.33

ECONOMIC IMPACT: The implementation of the amendment is expected to save the School District approximately $250,000 – $365,000 annually.

A public hearing will be held by the School Board of Walton County, Florida at 5:00 o’clock p.m. during the regular board meeting on July 15, 2008, in the Board Room at the Tivoli Administrative Center, 145 Park Street, DeFuniak Springs, Florida for the purpose of considering the proposed amendment. Any interested person may appear at the hearing and present evidence and argument and be heard concerning the proposed amendment. Immediately following the public hearing the School Board of Walton County, Florida will consider action to adopt the amendment.

The amendment will consist of a paragraph added to School Board Policy 6.13 that consists of the following text: “Beginning with School Year 2008-2009, teachers shall not be given credit for years of experience for which they are drawing retirement funds. This provision will apply only to teachers who begin their contract with the Walton County School Board for School Year 2008-2009 or any subsequent year.”

If a person decides to appeal any decision made by the School Board with respect to any matter considered at such meeting or hearing, such person will need a record of the proceedings, and for such purpose, such person may need to ensure that a verbatim record of the proceedings, which record includes the testimony and evidence upon which the appeal is to be based.

PUBLIC HEARING NOTICE

The Walton County Zoning Board of Adjustments will hold their regular public hearing on June 26, 2008 at 6:00 P.M. at the South Walton Courthouse Annex in Santa Rosa Beach, Florida 32459. The following items are scheduled for review and action:

1. LYNN MUNYON ADMINISTRATIVE APPEAL - Project number 08-004-00002. Lynn Munyon is appealing an interpretation by the Walton County Planning and Development Services Division, dated April 3, 2008, that a change of use for his property from office to takeout restaurant would constitute an expansion of a nonconforming use.

2. AZLAND BORROW PIT – Project number 07-017-00002. This is a special exception application submitted by Lee Perry. This application proposes a borrow pit on 184.61 acres with a future land use of large scale agriculture. The site is located on Ed Brown Field Road, approximately .5 mile north of Rock Hill Road (parcel numbers 05-1N-18-08000-004-0000 and 06-1N-18-08000-004-0010.)

The Zoning Board of Adjustments will make a final determination to grant a variance, deny a variance, uphold the director’s decision, overturn the director’s decision, or continue to a later date. Any agenda item that is tabled will be scheduled for a future Zoning Board of Adjustments meeting. The applicant/petitioner may appeal the decision of this board to the Circuit Court of Walton County.

The project consists of two parts located at the Miramar Beach Regional Access (2375 Scenic Gulf Drive Destin, FL) adjacent to the western side of Pompano Joe’s restaurant in western Walton County. The first part of the project is the construction of an approximately 1,100 linear foot long concrete pile-supported parking deck on the southern side of Scenic Gulf Drive. The construction will require the removal of the existing parking structure and all activities necessary to reconnect utilities and the restroom facility to existing systems. The project also includes the relocation of existing utilities and will require traffic control measures to be implemented on site due to its proximity to Scenic Gulf Drive (old Hwy. 98).

The second part of the project consists of demolishing an existing asphalt parking lot and repaving with a new parking lot design. This parking area is located on the north side of Scenic Gulf Drive across from the western end of the parking deck, and will serve as a staging area for the first phase of the project. The existing northern parking lot has asphalt, concrete curbing, and gravel that will be demolished and removed. There will be a minimum of 12” of subgrade that will be required in addition to 8” of limerock base along with 2” of SP-12.5 asphalt. The parking lot will be sloped to allow the stormwater runoff to collect in the open swales that will be piped to a small pond in the northeast corner of the site. A 4’ tall timber retaining wall will be constructed along two sides of the pond for containment.

NOTICE OF INTENT OF THE SCHOOL BOARD OF WALTON COUNTY, FLORIDA

TO ADOPT THE 2008-2009 STUDENT
PROGRESSION PLAN

The School Board of Walton County, Florida, hereby gives notice of its intent to adopt the proposed 2008-2009 Student Progression Plan, which by reference is incorporated as part of School Board Rules, pursuant to the procedures set forth in the Administrative Procedures Act.

PURPOSE AND EFFECT: The purpose and effect of the adoption of the 2008-2009 Student Progression Plan is to present to school personnel, parents/guardians, students and other interested citizens the administrative procedures required to implement state legislative and local pupil progression requirements.

SUMMARY: The District Student Progression Plan is adopted each year by the School Board of Walton County, Florida, and sets forth the policies and procedures relative to enrollment, promotion, retention, accelerated/decelerated placement, transfers, instructional programs, accelerated programs, extended year programs, dropout prevention/retrieval programs, student assessment and exceptional student education.

LEGAL AUTHORITY: The adoption of the 2008-2009 Student Progression Plan is authorized by Sections 1001.41, 1008.25, 1008.34, 1001.03 and 1008.22 Florida Statutes, and the law implemented is Section 1008.25 Florida Statutes.

ECONOMIC IMPACT: The adoption of the 2008-2009 Student Progression Plan will not result in any additional costs to the School District.
A public hearing will be held by the School Board of Walton County, Florida, at 5:15 p.m. during the regular board meeting on July 15, 2008, in the Board Room at the Tivoli Administrative Complex, 145 Park Street, DeFuniak Springs, Florida, for the purpose of considering adoption of the 2008-2009 Student Progression Plan. Any interested person may appear at the hearing and present evidence and argument and be heard concerning the adoption of the 2008-2009 Student Progression Plan. Immediately following the public hearing the School Board of Walton County, Florida, will consider final action to adopt the 2008-2009 Student Progression Plan.

PUBLIC HEARING NOTICE

The Walton County Technical Review Committee will hold a public hearing on Wednesday, July 2, 2008 at 8:30 am at the South Walton Courthouse Annex in Santa Rosa Beach, FL 32459. The following items are scheduled for review and action:

1. TOPS’L DRI NOPC – Project number 08-022-00001. This is a notice of proposed change for the Tops’l Development of Regional Impact (DRI) submitted by Jesse Rigby. The request is to modify 115 one-bedroom condominium units to 114 hotel rooms. The proposed change will affect 3.33 acres of the 52 acre Tops’l DRI, which has a future land use of coastal center. The site is on the south side of U.S. 98 between Four Mile Village and Sandestin Golf and Beach Resort (parcel number 35-2S-21-42100-002-0000).

2. HOMEWOOD SUITES AT TOPS’L – Project number 08-001-00034. This is a minor development order application submitted by Emerald Coast Associates, consisting of a 94,643 square foot hotel on 3.33 acres with a future land use of coastal center. This hotel is part of the previously approved Tops’l Development of Regional Impact. The site is on the west side of Tops’l Beach Boulevard approximately 500 feet south of U. S. 98 West (parcel number 35-2S-21-42100-002-0000).

3. EMERALD GLENN @ BLACK CREEK PH. I & II - Project number 08-001-00036. This is a minor development order application submitted by Jennifer Christensen, P&B Management, consisting of 136 residential lots on 833 acres with a future land use of rural town center. This project is phase I and II of the Black Creek Equestrian and River Resort PUD. The site is on the north side of C.R. 3280, approximately 8 miles east of U.S. 331 (parcel numbers 02-2S-18-15000-001-0010, 03-2S-18-15000-001-0020, 10-2S-18-15000-001-0020, & 11-2S-18-15000-001-0010).

4. ASSISI VILLAS PHASE I PLAT – Project number 08-003-00011. This is a preliminary plat application submitted by Darrell Barnhill, consisting of a 40 lot single-family subdivision on +/- 10.14 acres with a future land use of NPA/infill. The site is on the east side of Thompson Road, approximately 1,400 feet south of U.S. 98 (parcel number 34-2S-20-33270-060-0000).

The Design Review Board will make a recommendation on major developments to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny. Any item that is tabled will be scheduled for a future Design Review Board meeting and will not go forward to the Planning Commission until the Design Review Board makes a recommendation.

The Department issues this cumulative notice of intent to find the remedial Walton County Comprehensive Plan Amendment (Coastal Zone/Conservation Element Policy C-4.2.6) adopted by Ordinance No(s). 2007-22 on August 28, 2007 and the remedial amendment(s) adopted by Ordinance 2008-07 on March 11, 2008 IN COMPLIANCE, pursuant to Sections 163.3184, 163.3187 and 163.3189, F.S.

The adopted Walton County Comprehensive Plan Amendment and the Department’s Objections, Recommendations, and Comments Report, (if any), are available for public inspection Monday through Friday, except for legal holidays, during normal business hours, at Walton County Planning and Development, 31 Coastal Centre Boulevard, Suite 10, Santa Rosa Beach, Florida 32459.

Any affected person, as defined in Section 163.3184, F.S., has a right to petition for an administrative hearing to challenge the proposed agency determination that the Remedial Amendments are In Compliance, as defined in Subsection 163.3184(1), F.S. The petition must be filed within twenty-one (21) days after publication of this notice, and must include all of the information and contents described in Uniform Rule 28-106.201, F.A.C. The petition must be filed with the Agency Clerk, Department of Community Affairs, 2555 Shumard Oak Boulevard, Tallahassee, Florida 32399-2100 and a copy mailed or delivered to the local government. Failure to timely file a petition shall constitute a waiver of any right to request an administrative proceeding as a petitioner under Sections 120.569 and 120.57, F.S. If a petition is filed, the purpose of the administrative hearing will be to present evidence and testimony and forward a recommended order to the Department. If no petition is filed, this Notice of Intent shall become final agency action.

If a petition is filed, other affected persons may petition for leave to intervene in the proceeding. Notice of Receipt of
Stormwater Application

Notice is hereby given that pursuant to Chapter 373, Florida Statutes and Chapter 62-346, Florida Administrative Code (F.A.C.), the following applications for an Individual Stormwater Permit have been received by the Northwest Florida Water Management District:

Application #279 received May 9, 2008 from William P. Wyllie, President WMSU, Inc. for construction of an 8,354 sq.ft. building (Bayou Bills Crab House), 32,587 sq.ft. of asphalt paving and concrete sidewalk and curb, and a stormwater management facility at 4748 Highway 98 W., Santa Rosa Beach.

Application #282 received May 9, 2008 from Frank Kovach, Resort Investments, Inc., for expansion of Resort Interiors Sales by construction of a new 3,300 square foot warehouse space with associated vehicular use areas and a stormwater management facility at 106 Geronimo Street, North Sandestin.

Application #298, received May 21, 2008, from Lee Perry for development of a 67 acre borrow pit for sand mining purposes on 207 acres on Rock Hill Road, two miles east of U.S. 331, Freeport.

Application #302, received May 23, 2008, from the City of DeFuniak Springs for construction of a new paved access road, paved auto parking lot, and stormwater management facility at the DeFuniak Springs Airport, US Hwy. 90 and US Hwy. 331 N., DeFuniak Springs.

Application #320 received June 5, 2008, from Russell D. Komman, Sundance Property Management, Inc. for construction of Four Mile Landing, Phase I, a 96 unit apartment complex with associated parking and drives, sidewalks, playground, pool, bus stops, and stormwater management facilities on 14.6 acres at 568 Four Mile Road, Freeport.

Interested persons may comment upon these applications or submit a written request for a staff report containing proposed agency action regarding the application by writing the Northwest Florida Water Management District’s ERP Office, 800 Hospital Dr., Crestview, FL. Such comments or requests must be received by 5:00 p.m. within 14 days from date of publication.

No further public notice will be provided regarding these applications. Persons wishing to remain advised of further proceedings or to receive a copy of the Technical Staff Report should request that in writing to the address above or by e-mail to ErpPermits@nwfwmd.state.fl.us.

Substantially affected persons are entitled to request an administrative hearing, pursuant to Title 28, Florida Administrative Code, regarding the proposed agency action by submitting a written request after reviewing the staff report.
