3. MAGNOLIA DUNES ABANDONMENT VIA REPLAT - Project number 06-003-00002. This is an abandonment application submitted by BankTrust and McNeil Carroll Engineering and Surveying, Inc., requesting abandonment of the easement located within the rear yards of lots 14, 15, 23, and 24 of Magnolia Dunes Subdivision, and to replat the four lots to contain in the rear yards a common area of 42 feet by 110 feet. This 20-foot access and utility easement, per the plat recorded at Plat Book 11, Pages 6 and 6A, in the Public Records of Walton County, Florida, contains approximately 0.3880 of an acre. The Department of Environmental Protection, Bureau of Beaches and Coastal Systems, is soliciting public comments on an application for a coastal construction control line permit submitted by Mr. Ezzeldin M. Benghuzzi, P.E., Quantum Engineering Group, Inc., pursuant to Chapter 161.053, Florida Statutes, and 62B-33, Florida Administrative Code.

This application is for the after-the-fact construction of an armoring structure. Project location: Between approximately 100 feet and 250 feet east of the Department of Environmental Protection’s reference monument R-59, in Walton County. Project address: Sea Bluff Condominiums, 2381 West County Road 30-A, Santa Rosa Beach. Plans for this proposed project are available for public inspection or, by appointment, at the office of the Bureau of Beaches and Coastal Systems at 5050 West Tennessee Street, Building B, Tallahassee, Florida, from 8:00 A.M. to 5:00 P.M.

This public comment notice is being distributed in order to assist the Department of Environmental Protection in developing facts on which to base a decision on the permit application. For accuracy and completeness, all comments should be submitted in writing with supporting data, evidence, or rationale to furnish a clear understanding of the basis for the comments. The decisions as to whether a permit will be issued will be based on an evaluation of: (1) The design adequacy of the proposed construction. The Walton County Design Review Board will hold a regular public meeting to hear projects beginning at 5:00 p.m. on Thursday, December 3, 2009 at the South Walton County Courthouse Annex located at 31 Coastal Centre Boulevard, Santa Rosa Beach, Florida 32459. The Design Review Board will make a recommendation on major developments to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny. Any item that is tabled will be scheduled for a future Design Review Board meeting and will not go forward to the Planning Commission until the Design Review Board makes a recommendation.

PUBLIC HEARING NOTICE

The Walton County Technical Review Committee will hold a public hearing on Wednesday, December 2, 2009 at 8:30 am at the South Walton Courthouse Annex in Santa Rosa Beach, FL 32459. The following items are scheduled for review and action:

1. U.S. 98 & S.R. 30A CELL TOWER - Project number 09-001-00041. This is a major development order application submitted by Lane Wright, requesting approval for a 105-foot portable cell tower on 9.998 acres, with a future land use of light industrial. The site is at 161 Goldsby Road (parcel number 25-1S-21-42000-014-0000).

In accordance with Section 286.26, Florida Statutes, whenever any board of commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision, which has scheduled a meeting at which official acts are to be taken receives, at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.
