In the Matter of the
Termination of the
Parental Rights of the
Biological Parents
of BABY BOY NEWMAN, a/ka/, MICHAEL JOSEPH NEWMAN,
an Infant.
Filed 9/11/09
No. FA-2009-134
Judge Jesse S. Harris
NOTICE TO THOMAS JOPLIN OF HEARING
PETITION FOR TERMINATION OF PARENTAL RIGHTS
OF THE BIOLOGICAL PARENTS OF
BABY BOY NEWMAN, a/k/a
MICHAEL JOSEPH NEWMAN
THE STATE OF OKLAHOMA TO: THOMAS JOPLIN
PLEASE TAKE NOTICE that on the 22nd day of May, 2009, a petition was filed in this Court for termination of the parental rights of the biological parents of Baby Boy Newman, a/k/a Michael Joseph Newman, a/k/a Michael Thomas Newman (“the Child”), a child born on April 24, 2009, at Tahlequah City Hospital in Tahlequah, Cherokee County, Oklahoma, so that the adoption of the Child may occur.
Petitioner alleged in its Petition that you are a possible biological father of the Child and that you, having actual knowledge of the birth or of the impending birth of the Child, and having statutory presumptive notice that the biological mother may be pregnant and actual knowledge that the biological mother was pregnant and that you may be the biological father of the Child, have: (1) failed to prove you are the father of the Child; (2) failed to exercise parental rights or duties over the Child, including but not limited to having failed to contribute to the support, either monetarily or non-monetarily, of the Child’s biological mother or the Child to the extent of your financial ability since the date of conception of the Child; (3) failed to make sufficient attempts to discover if you had fathered the Child prior to the receipt of notice; (4) failed to make sufficient attempts to exercise parental rights and duties toward the Child prior to the receipt of notice; (5) to the extent you are or may be entitled to custody of the Child, abandoned the Child; and (6) failed to establish or create a legally-existing parental relationship with the Child.
YOU ARE, THEREFORE, NOTIFIED THAT the Court will consider the Petition to terminate your parental rights on the 16th day of October, 2009, at the hour of 1:30 o’clock P.M., before the Honorable Jesse S. Harris in District Courtroom #508 of the District Courthouse of Tulsa County, 500 South Denver Avenue, Tulsa, Oklahoma, 74103, (918) 596-5000, at which time the Court will hear evidence in support of and in opposition to the granting of the Petition at the time and place shown above, where you will have the right to be present, have an opportunity to be heard at said time and place, and have the right to object to the termination of your parental rights, if any, regarding the Child.
YOUR FAILURE TO APPEAR AT SAID HEARING SHALL COMMUNICATE YOUR DECISION NOT TO OPPOSE THE PETITION AND SHALL CONSTITUTE A DENIAL OF YOUR INTEREST IN THE CHILD, WHICH DENIAL MAY RESULT, WITHOUT FURTHER NOTICE TO YOU OF THIS PROCEEDING OR ANY SUBSEQUENT PROCEEDING, IN THE TERMINATION OF ALL YOUR PARENTAL RIGHTS REGARDING SAID CHILD, IN ACCORDANCE WITH THE LAWS OF THE STATE OF OKLAHOMA, AND IN THE ADOPTION OF SAID CHILD.
YOU ARE FURTHER NOTIFIED THAT, if you are the biological father of the Child, then your duty to contribute to the support of the Child continues after your parental rights have been terminated.
A copy of the Petition is available upon application and approval by the Court.
Done in open court this 4th day of September, 2009.
