PUBLIC HEARING NOTICE
The Walton County Zoning Board of Adjustment will hold their regular public hearing on Thursday, August 27, 2009 at 6:00 P.M. at the South Walton Courthouse Annex in Santa Rosa Beach, Florida 32459. The following items are scheduled for review and action:
1. D & H SAND PIT SPECIAL EXCEPTION – Project number 08-017-00001. This is a special exception application submitted by Emerald Coast Associates for Djuna Cheatum, requesting approval of mining sand on 121.7 acres with a future land use of large-scale agriculture. The site is at 760 Sand Plant Road, off Rock Hill Road (parcel number 18-2N-17-05000-004-0020).
The Zoning Board of Adjustment will make a final determination to grant a variance, deny a variance, uphold the director’s decision, overturn the director’s decision, or continue to a later date. Any agenda item that is tabled will be scheduled for a future Zoning Board of Adjustment meeting. The applicant/petitioner may appeal the decision of this board to the Circuit Court of Walton County.

LEGISLATIVE ITEMS:
1. DEVELOPMENT ORDER EXTENSION AMENDMENT ORDINANCE – An ordinance of Walton County, Florida, amending Sections 3.01.03c, 11.01.05b, and 11.01.06c of the Walton County Land Development Code to allow an exception that would extend by two years the time in which final orders, minor development orders, and major development orders shall remain valid; providing a sunset provision; providing for retroactive effect of the amendment; and providing an effective date.
QUASI-JUDICIAL ITEMS:
3. TOPSAIL WEST CONCEPTUAL PUD – Project number 09-001-00011. This is a major development order application submitted by St. Joe Co., consisting of 31 mixed-use buildings including 308,300 square feet of retail, 5,000 square feet of office space, 190 senior living units, 110 assisted living units, and 310 multi-family units on 119.785 acres, which are variously designated as TC-2 and VMU. The site is on the northwest corner of the U.S. 98 and C.R.30A intersection (parcel numbers 29-2S-20-33000-011-0010, 29-2S-20-33000-050-0000, and 30-2S-20-33230-000-001A).
4. THE MARKET SHOPS – SANDESTIN NOPC – Project number 09-022-00001. This is a notice of proposed change (NOPC) for the Sandestin Development of Regional Impact (DRI) submitted by Sharon Gold. The request proposes an E2 change of use from commercial to commercial and school for Parcel 108C, to allow Intrawest to locate a private school in a 770 square foot space. The Compass Rose Academy would enroll approximately 24 children from Pre-Kindergarten through Grade 5, with a primary focus on children with special learning needs. The site is at 9375 Emerald Coast Parkway West (parcel number 27-2S-21-42000-001-0120).
5. VILLAS AT INLET BEACH PUD – Project number 08-001-00068. This is a major development application submitted by Century Bank, requesting an amendment to an existing development order. The applicant is requesting to limit height and adjust setbacks. The site is at 246 Winston Lane (parcel numbers 36-3S-18-16115-000-0010, 36-3S-18-16115-000-0030, 36-3S-18-16115-000-0040, 36-3S-18-16115-000-0050, 36-3S-18-16115-000-0060, 36-3S-18-16115-000-0070, 36-3S-18-16115-000-0080, 36-3S-18-16115-000-0090, 36-3S-18-16115-000-0100, 36-3S-18-16115-000-0110).

NOTICE OF FINAL AGENCY ACTION TAKEN BY THE NORTHWEST FLORIDA WATER MANAGEMENT DISTRICT
Notice is given that stormwater permit number 631 was issued on August 3, 2009, to Beach Florida Investments for demolition of existing impervious area and construction of a new, 2-story, 2,000 sq. ft. office building and stormwater management facility on County Road 395 contiguous to the north property line of Regions Bank, Seagrove Beach.
The file containing the application for this permit is available for inspection Monday through Friday (except for legal holidays), 8:00 a.m. to 5:00 p.m. at the Northwest Florida Water Management District’s ERP Office, 800 Hospital Drive, Crestview, FL 32539.
A person whose substantial interests are affected by the District permitting decision may petition for an administrative hearing in accordance with Sections 120.569 and 120.57 F.S., or may choose to pursue mediation as an alternative remedy under Section 120.573, Florida Statutes, and Rules 28-106.111 and 28-106.401-404, Florida Administrative Code. Petitions must comply with the requirements of Florida Administrative Code, Chapter 28-106 and be filed with (received by) the District Clerk located at District Headquarters, 81 Water Management Drive, Havana, FL 32333-4712. Petitions for administrative hearing on the above application must be filed within twenty-one (21) days of publication of this notice or within twenty-six (26) days of the District depositing notice of this intent in the mail for those persons to whom the District mails actual notice. Failure to file a petition within this time period shall constitute a waiver of any right(s) such person(s) may have to request an administrative determination (hearing) under Sections 120.569 and 129.57, F.S., concerning the subject permit. Petitions which are not filed in accordance with the above provisions are subject to dismissal.
Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the District’s final action may be different from the position taken by it in this notice of intent.
