On Thursday May 29, 2008 at 9:00 a.m., Cliff Knauer of Preble-Rish will lead the Walton County Coastal Dune Lake Advisory Board on a tour of the drainage and stormwater issues that are impacting the water quality of Walton County’s coastal dune lakes. The Board and others interested in participating will meet at the Coastal Branch Library in Santa Rosa Beach, Florida at 9:00 am. TO ADOPT A PROPOSED RULE

The School Board of Walton County, Florida, hereby gives notice of its intent to adopt a new school board rule, the title of which is Walton County School District Wellness Policy 2008, pursuant to the procedures set forth in the administrative procedures Act.

PURPOSE AND EFFECT: The purpose and effect of the proposed rule is to set forth programs and procedures on wellness for all students in the Walton County School District.

SUMMARY: The proposed rule sets forth the various programs on wellness for students in the Walton County School District and how they will be implemented.

LEGAL AUTHORITY: The adoption of the proposed rule is authorized by Section 1001.41, 1001.42, 1001.43, 1003.42, 1006.06, 1006.0606, 1003.455, 1003.429, 1003.43, and 381.0056, Florida Statutes, and the laws implemented are Child Nutrition Act of 1966 (42 USC 1771 et seq) Richard B. Russell National Lunch Act PL 108-265, Section 204, and State Board of Education Rules 6A-7.0411.

ECONOMIC IMPACT: The proposed rule will not result in additional cost to the School Board. There has been no agency statement of estimated regulatory cost prepared.

A public hearing will be held by the School Board of Walton County, Florida, at 5:15 o’clock p.m. during the regular board meeting on July 1, 2008 in the Board Room at the Tivoli Administrative Complex, 145 Park Street, DeFuniak Springs, Florida, for the purpose of considering adoption of the proposed rule. Any interested person may appear at the hearing and present evidence and argument and be heard concerning the adoption of the proposed rule. Immediately following the public hearing the School Board of Walton County, Florida will consider final action to adopt the proposed rule.

The Department of Environmental Protection gives notice of its intent to issue a construction permit to Florida Transformer, Inc. (FTI), located at 4509 State Highway 83 North in Walton County.

This construction permit is to consolidate all emission units from the two adjacent facilities’ permits under facility ID numbers 1310017 (Enviro-Lectric) and 1310252 (Florida Transformer) under one permit and one facility ID No. since both facilities are now under one owner. FTI is an industrial facility specializing in the following: repair of electrical transformers used in residential subdivisions (light duty) and industrial/commercial (heavy duty) units, manufacture of special order transformers, and decommissioning of transformers not suitable for repair. This facility is synthetically limited to be a minor source of air pollution.

The permitting authority will issue the FINAL Permit, in accordance with the conditions of the DRAFT Permit unless a response received in accordance with the following procedures results in a different decision or significant change of terms or conditions.

The Permitting Authority will accept written comments concerning the DRAFT Permit for a period of fourteen (14) days from the date of publication of the “PUBLIC NOTICE OF INTENT TO ISSUE PERMIT.” Written comments must be post-marked and all facsimile comments must be received by the close of business (5:00 pm), on or before the end of this 14-day period, by the Permitting Authority at 160 Governmental Center, Pensacola, Florida 32502-5794 or by facsimile at 850/595-8096. For additional information, contact the Permitting Authority at the above address or by phone at 850/595-8300. If written comments result in a significant change to the DRAFT Permit, the Permitting Authority shall issue a Revised DRAFT Permit. All comments filed will be made available for public inspection.

A person whose substantial interests are affected by the Department’s proposed permitting decision may petition for an administrative proceeding (hearing) in accordance with Section 120.57, Florida Statutes. The petition must contain the information set forth below and must be filed (received) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Tallahassee, Florida 32399-3000, within 14 days of publication of this notice. Petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing. The petition shall contain the following information; (a) The name, address, and telephone number of each petitioner, the applicant’s name and address, the Department Permit File Number and the county in which the project is proposed; (b) A statement of how and when each petitioner received notice of the Department’s action or proposed action; (c) A statement of how each petitioner’s substantial interests are affected by the Department’s action or proposed action; (d) A statement of the material facts disputed by petitioner, if any; (e) A statement of facts which petitioner contends warrant reversal or modification of the Department’s action or proposed action; (f) A statement of which rules or statutes petitioner contends require reversal or modification of the Department’s action or proposed action; and (g) A statement of the relief sought by petitioner, stating precisely the action petitioner wants the Department to take with respect to the Department’s action or proposed action.

If a petition is filed, the administrative hearing process is designed to formulate agency action. Accordingly, the Department’s final action may be different from the position taken by it in this Notice. Persons whose substantial interests will be affected by any decision of the Department with regard to the application have the right to petition to become a party to the proceeding.
