NOTICE OF INTENT TO THE SCHOOL BOARD OF WALTON COUNTY, FLORIDA TO ADOPT THE 2009-2010 STUDENT PROGRESSION PLAN

The School Board of Walton County, Florida, hereby gives notice of its intent to adopt the proposed 2009-2010 Student Progression Plan, which by reference is incorporated as part of School Board Rules, pursuant to the procedures set forth in the Administative Procedures Act.

PURPOSE AND EFFECT: The purpose and effect of the adoption of the 2009-2010 Student Progression Plan is to present to school personnel, parents/guardians, students and other interested citizens the administrative procedures required to implement state legislative and local pupil progression requirements.

SUMMARY: The District Student Progression Plan is adopted each year by the School Board of Walton County, Florida, and sets forth the policies and procedures relative to enrollment, promotion, retention, accelerated/decelerated placement, transfers, instructional programs, accelerated programs, extended year programs, dropout prevention/retrieval programs, student assessment and exceptional student education.

LEGAL AUTHORITY: The adoption of the 2009-2010 Student Progression Plan is authorized by Sections 1001.41, 1008.25, 1008.34, 1001.03 and 1008.22 Florida Statutes, and the law implemented is Section 1008.25 Florida Statutes.

ECONOMIC IMPACT: The adoption of the 2009-2010 Student Progression Plan will not result in any additional costs to the School District.

A public hearing will be held by the School Board of Walton County, Florida, at 5:15 p.m. during the regular board meeting on July 7, 2009, in the Board Room at the Tivoli Administrative Complex, 145 Park Street, DeFuniak Springs, Florida, for the purpose of considering adoption of the 2009-2010 Student Progression Plan. Any interested person may appear at the hearing and present evidence and argument and be heard concerning the adoption of the 2009-2010 Student Progression Plan. Immediately following the public hearing the School Board of Walton County, Florida, will consider final action to adopt the 2009-2010 Student Progression Plan.

The entire text of the 2009-2010 Student Progression Plan is on file and available for inspection during regular office hours at the office of the Superintendent of Schools, Walton County, Florida, located at 145 Park Street, Suite 2, DeFuniak Springs, Florida. Copies of the 2009-2010 Student Progression Plan are available to the public at the Superintendent’s office.

If a person decides to appeal any decision made by the School Board with respect to any matter considered at such meeting or hearing, such person will need a record of the proceedings, and for such purpose, such person may need to ensure that a verbatim record of the proceedings, which record includes the testimony and evidence upon which the appeal is to be based.

The School Board of Walton County does not discriminate upon the basis of any individual’s disability status. Anyone requiring reasonable accommodation as provided for in the Americans with Disabilities Act to ensure to or participation in the hearing should contact Toni Courtney, Secretary to the Superintendent, at (850) 892-1100 at least two (2) business days in advance to make appropriate arrangements.

The name of the person originating the 2009-2010 Student Progression Plan is David Jeslenik and the name of the person approving the 2009-2010 Student Progression Plan for consideration by the School Board is Carlene H. Anderson.

The School Board of Walton County, Florida, hereby gives notice of its intent to adopt the proposed 2009-2010 Elementary District Uniform Code of Student Conduct and the proposed 2009-2010 Secondary District Uniform Code of Student Conduct, which by reference are incorporated as part of School Board rules, pursuant to the procedures set forth in the Administrative Procedures Act.

PURPOSE AND EFFECT: The purpose and effect of the adoption of the 2009-2010 District Uniform Codes of Student Conduct is to set forth the rights and responsibilities of students attending school in the Walton County School District and provide the rules of conduct and discipline that apply to such students.

SUMMARY: The District Uniform Code of Student Conduct is adopted each year by the School Board of Walton County, Florida, and set forth the rights and responsibilities of students attending schools in the Walton County School District and the rules of conduct such students must follow. In addition, the codes of conduct set forth infractions that are considered grounds for disciplinary action and the recommended disciplinary action.

PUBLIC HEARING NOTICE

GULF PINES NEIGHBORHOOD PLAN – Project number 08-023-00001.  An ordinance amending Section 2.03.02 of the Walton County Land Development Code to adopt the Gulf Pines Neighborhood Plan as an overlay district; establishing a defined boundary; establishing that the intent of the plan is to preserve the residential character of the Gulf Pines neighborhood and to ensure the continued stability of the subdivision; establishing development standards; establishing provisions for permitted uses, minimum and maximum lot sizes, setbacks, build-to-lines, lot coverage, building height, allowable densities and accessory structures, prohibited uses, parking restrictions, common areas, recreation areas, and parking facilities; establishing restrictions on further subdivision of lots, restrictions on animals; establishing provisions for legal non-conformities; providing for the incorporation of the Gulf Pines Neighborhood Plan as Appendix NP-4 to the Walton County Land Development Code; providing for severability; and providing for an effective date.

3. ST. JOE ICW SPOILS SPECIAL EXCEPTION – Project number 09-017-00001.  This is a special exception application submitted by St. Joe Timberland Company of Delaware, requesting approval to remove intra-coastal waterway (ICW) spoil material from the Army Corps of Engineers easement, which has a future land use of large-scale agriculture. The site is adjacent to 390 Serenoa Road (parcel numbers 03-3S-18-16000-001-0000, 04-3S-18-16000-001-0000, 11-3S-18-16000-001-0000, 13-3S-18-16000-001-0000, and 05-3S-18-16000-001-0000).

The Walton County Planning Commission will hold a public meeting on Thursday, July 9, 2009, at the South Walton County Courthouse Annex located at 31 Coastal Centre Boulevard, Santa Rosa Beach, Florida 32459, beginning at 5:00 pm, to hear the following items:

In accordance with Section 286.26, Florida Statutes, whenever any board or commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision, which has scheduled a meeting at which official acts are to be taken receives, at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting, directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.

The Department of Environmental Protection gives notice of its intent to issue a permit and Administrative Order for the South Walton Utility Company, Inc. WWTP to the South Walton Utility Company, Inc., 369 Miramar Beach Drive, Miramar Beach, FL 32550 for renewal of existing 2.5 MGD monthly average daily flow (MADF) permitted capacity extended aeration wastewater treatment plant capacity.  This permit authorizes continuation of construction and operation that was granted by permit revision FL0102482-006-DW1P/RA effective September 4, 2007 to upgrade the treatment plant to accomplish advanced wastewater treatment (AWT) and to expand the wastewater treatment plant capacity to 2.75 MGD annual average daily flow (AADF).  The treatment plant will operate in the extended aeration mode and will have provisions for pretreatment, equalization, nitrification, denitrification, clarification, tertiary filtration, high level disinfection, dechlorination, aerobic sludge digestion, and residual handling system.

The reclaimed water is reused either by an existing 4.355 MGD AADF permitted capacity general service area, R-001, for Part III public access reuse system or it is directed to rapid infiltration basin system, R-002, consisting of 12 rapid infiltration basins located approximately at latitude 30o 22’ 44.5” N, longitude 86 o 21’ 47.1” W. Surface Water Discharge, D-001, initially permitted by revision FL0102482-006-DW1P/RA on September 4, 2007 is a 1.35 MGD MADF backup discharge to unnamed FDOT ditch system adjacent to the west side of the WWTP along Highway 98, flowing to Choctawhatchee Bay.  The point of discharge is located approximately at latitude 30 o 22’ 55.1” N, longitude 86 o 21’ 28.9” W.  This permit also authorizes  a new 2.0 MGD AADF permitted discharge, D-002, Wetland Application System, a receiving freshwater wetlands system consisting of four wetland basins SW-2, SW-5, SW-10 and SW-8 totaling approximately 259.4 acres, which flow to Choctawhatchee Bay located in Walton and Okaloosa Counties, approximately at latitude 30o 23’ 25.6” N, longitude 86o 24’ 58.7” W.

The intent to issue and application file are available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at Northwest District Office, Florida Dept. of Environmental Protection, 160 Governmental Center, Suite 308, Pensacola, FL 32502-5794.

The Department will issue the permit with the attached conditions unless a timely petition for an administrative hearing is filed under Sections 120.569 and 120.57, Florida Statutes, within fourteen days of receipt of notice.  The procedures for petitioning for a hearing are set forth below.

A person whose substantial interests are affected by the Department’s proposed permitting decision may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57, Florida Statutes.  The petition must contain the information set forth below and must be filed (received by the clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000.

Under Rule 62-110.106(4), Florida Administrative Code, a person may request enlargement of the time for filing a petition for an administrative hearing.  The request must be filed (received by the clerk) in the Office of General Counsel before the end of the time period for filing a petition for an administrative hearing.

Petitions filed by any persons other than those entitled to written notice under Section 120.60(3), Florida Statutes, must be filed within fourteen days of publication of the notice or within fourteen days of receipt of the written notice, whichever occurs first.  Under Section 120.60(3), Florida Statutes, however, any person who has asked the Department for notice of agency action may file a petition within fourteen days of receipt of such notice, regardless of the date of publication.

The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing.  The failure of any person to file a petition within fourteen days of receipt of notice shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, Florida Statutes.  Any subsequent intervention (in a proceeding initiated by another party) will be only at the discretion of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, Florida Administrative Code.

A petition that disputes the material facts on which the Department’s action is based must contain the following information:

(a) The name, address, and telephone number of each petitioner; the name, address, and telephone number of the petitioner’s representative, if any; the Department permit identification number and the county in which the subject matter or activity is located;

(b) A statement of how and when each petitioner received notice of the Department action;

(c) A statement of how each petitioner’s substantial interests are affected by the Department action;

(d) A statement of all disputed issues of material fact.  If there are none, the petition must so indicate;

(e) A statement of facts that the petitioner contends warrant reversal or modification of the Department action;

(f) A concise statement of the ultimate facts alleged, as well as the rules and statutes which entitle the petitioner to relief; and

(g) A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wants the Department to take.

Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Department’s final action may be different from the position taken by it in this notice.  Persons whose substantial interests will be affected by any such final decision of the Department have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above.

Mediation under Section 120.573, Florida Statutes, is not available for this proceeding.
