NOTICE OF INTENT TO THE SCHOOL BOARD OF WALTON COUNTY, FLORIDA TO ADOPT THE 2009-2010 STUDENT PROGRESSION PLAN

The School Board of Walton County, Florida, hereby gives notice of its intent to adopt the proposed 2009-2010 Student Progression Plan, which by reference is incorporated as part of School Board Rules, pursuant to the procedures set forth in the Administative Procedures Act.

PURPOSE AND EFFECT: The purpose and effect of the adoption of the 2009-2010 Student Progression Plan is to present to school personnel, parents/guardians, students and other interested citizens the administrative procedures required to implement state legislative and local pupil progression requirements.

SUMMARY: The District Student Progression Plan is adopted each year by the School Board of Walton County, Florida, and sets forth the policies and procedures relative to enrollment, promotion, retention, accelerated/decelerated placement, transfers, instructional programs, accelerated programs, extended year programs, dropout prevention/retrieval programs, student assessment and exceptional student education.

LEGAL AUTHORITY: The adoption of the 2009-2010 Student Progression Plan is authorized by Sections 1001.41, 1008.25, 1008.34, 1001.03 and 1008.22 Florida Statutes, and the law implemented is Section 1008.25 Florida Statutes.

ECONOMIC IMPACT: The adoption of the 2009-2010 Student Progression Plan will not result in any additional costs to the School District.

A public hearing will be held by the School Board of Walton County, Florida, at 5:15 p.m. during the regular board meeting on July 7, 2009, in the Board Room at the Tivoli Administrative Complex, 145 Park Street, DeFuniak Springs, Florida, for the purpose of considering adoption of the 2009-2010 Student Progression Plan. Any interested person may appear at the hearing and present evidence and argument and be heard concerning the adoption of the 2009-2010 Student Progression Plan. Immediately following the public hearing the School Board of Walton County, Florida, will consider final action to adopt the 2009-2010 Student Progression Plan.

The entire text of the 2009-2010 Student Progression Plan is on file and available for inspection during regular office hours at the office of the Superintendent of Schools, Walton County, Florida, located at 145 Park Street, Suite 2, DeFuniak Springs, Florida. Copies of the 2009-2010 Student Progression Plan are available to the public at the Superintendent’s office.

If a person decides to appeal any decision made by the School Board with respect to any matter considered at such meeting or hearing, such person will need a record of the proceedings, and for such purpose, such person may need to ensure that a verbatim record of the proceedings, which record includes the testimony and evidence upon which the appeal is to be based.

The School Board of Walton County does not discriminate upon the basis of any individual’s disability status. The City of DeFuniak Springs, Florida is soliciting proposals for providing general professional IT services and consulting to all City of DeFuniak Springs departments.

Professional services required shall be secured in accordance with Rule 9B-43, 24 CFR 85.36 and Section 287.055, Fla. Stat. – “Consultants’ Competitive Negotiations Act”. Entities interested in submitting a proposal should contact Michelle Schack, Administrative Assistant at P.O. Box 685, DeFuniak Springs, FL 32435 or (850) 892-8500, between the normal office hours of 8:00 a.m. to 5:00 p.m., to obtain the list of criteria which will be used to complete the proposal. The deadline for submission to the City of DeFuniak Springs Florida is June 17, 2009 at 2:00 p.m. Any proposals received after 2:00 p.m. on the above date will not be accepted and will be returned unopened.

To be considered, entity must be knowledgeable of rules and regulations for governmental IT requirements and familiar with the State of Florida Sunshine Law requirements. Awarding agreement will be contingent upon successful completion of a background check for security purposes.

The City of DeFuniak Springs reserves the right to accept or reject any or all proposals, and if an award is made, it will be made to the most responsible IT Consultant whose proposal indicates that the award will be in the best interest of the City of DeFuniak Springs. The City reserves the right to waive any irregularities in the proposal. The Walton County Code Enforcement Board will hold their regular meeting on June 18, 2009 beginning at 6:00 p.m. to be held at the South Walton Courthouse Annex.

NOTICE OF INTENT OF THE SCHOOL BOARD OF WALTON COUNTY, FLORIDA TO ADOPT THE 2009-2010  ELEMENTARY DISTRICT UNIFORM CODE OF STUDENT CONDUCT AND THE 2009-2010 SECONDARY DISTRICT UNIFORM CODE OF CONDUCT

The School Board of Walton County, Florida, hereby gives notice of its intent to adopt the proposed 2009-2010 Elementary District Uniform Code of Student Conduct and the proposed 2009-2010 Secondary District Uniform Code of Student Conduct, which by reference are incorporated as part of School Board rules, pursuant to the procedures set forth in the Administrative Procedures Act.

PURPOSE AND EFFECT: The purpose and effect of the adoption of the 2009-2010 District Uniform Codes of Student Conduct is to set forth the rights and responsibilities of students attending school in the Walton County School District and provide the rules of conduct and discipline that apply to such students.

SUMMARY: The District Uniform Code of Student Conduct is adopted each year by the School Board of Walton County, Florida, and set forth the rights and responsibilities of students attending schools in the Walton County School District and the rules of conduct such students must follow. In addition, the codes of conduct set forth infractions that are considered grounds for disciplinary action and the recommended disciplinary action.

LEGAL AUTHORITY: The adoption of the 2009-2010 Elementary District Uniform Code of Student Conduct and 2009-2010 Secondary District Uniform Code of Student Conduct is authorized by Sections 1001.41 and 1001.42, 1006.07, 1006.21, 1006.28 and 1012.22, Florida Statutes, and the law implemented in Section 1006.07, Florida Statutes.

ECONOMIC IMPACT: The adoption of the 2009-2010 District Uniform Codes of Student Conduct will not result in any additional costs to the School District.
A public hearing will be held by the School Board of Walton County, Florida, at 5:30 o’clock p.m. during the regular board meeting on July 7, 2009, in the Board Room at the Tivoli Administrative Complex, 145 Park Street, DeFuniak Springs, Florida, for the purpose of considering adoption of the 2009-2010 District Uniform Codes of Student Conduct. Any interested person may appear at the hearing and present evidence and argument and be heard concerning the adoption of the 2009-2010 District Uniform Codes of Student Conduct. Immediately following the public hearing the School Board of Walton County, Florida, will consider final action to adopt the 2009-2010 District Uniform Codes of Student Conduct.
The entire texts of the 2009-2010 Elementary and Secondary District Uniform Codes of Student Conduct are on file and available for inspection during regular office hours at the office of the Superintendent of Schools, Walton County, Florida, which office is located at 145 Park Street, Suite 2, DeFuniak Springs, Florida. Copies of the 2009-2010 District Uniform Codes of Student Conduct are available to the public at the Superintendent’s office.
If a person decides to appeal any decision made by the School Board with respect to any matter considered at such meeting or hearing, such person will need a record of the proceedings, and for such purpose, such person may need to ensure that a verbatim record of the proceedings is made, which record include the testimony and evidence upon which the appeal is to be based.
The School Board of Walton County does not discriminate upon the basis of any individual’s disability status. NOTICE OF INTENT TO ISSUE PERMIT
The Department of Environmental Protection gives notice of its intent to issue an environmental resources individual stormwater permit for Community Way Water Tank, 66-0078456-004-SI, to Walton County Board of Commissioners, c/o Lyle Seigler, Walton County Public Works, 117 Montgomery Circle, DeFuniak Springs, Florida 32433.

The purpose of the permit is to authorize construction of a 120 foot diameter water tank on 1.09 acres of a 20 acre parcel.  Stormwater treatment will be provided via retention ponds with site post-development discharge rates controlled to at or below the pre-development rates. A portion of the site development contains jurisdictional wetlands, for which a separate wetland resource management permit will be required.

Proper erosion control measures will be employed during construction.

The project will be located on Community Way, north of US 98 and west of U.S. Highway 331, in Santa Rosa Beach, in Walton County, Florida.

Based on all the above, and with the application of general and limiting specific conditions of the permit, the Department has reasonable assurance the project, as proposed, fully meets the environmental resources stormwater treatment requirements of Chapter 62-346, Florida Administrative Code, and will not harm the environment.

A person whose substantial interests are affected by the Department’s action may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57 of the Florida Statute.  The petition must contain the information set forth below and must be filed (received by the clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000.

Because the administrative hearing process is designed to re-determine final agency action on the application, the filing of a petition for an administrative hearing may result in a modification of the permit, or even a denial of the application.  Accordingly, the applicant will not commence construction or other activities under this permit until the deadlines below for filing a petition for an administrative hearing, or request for an extension of time have expired.

Under subsection 62-110.106(4) of the Florida Administrative Code, a person whose substantial interests are affected by the Department’s action may also request an extension of time to file a petition for an administrative hearing.  The Department may, for good cause shown, grant the request for an extension of time.   Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, before the applicable deadline.  A timely request for extension of time shall toll the running time period for filing a petition until the request is acted upon.  If a request is filed late, the Department may still grant it upon a motion by the requesting party showing that the failure to file a request for an extension of time before the deadline was the result of excusable neglect.

In the event that a timely and sufficient petition for an administrative hearing is filed, other persons whose substantial interests will be affected by the outcome of the administrative process have the right to petition to intervene in the proceeding.  Intervention will be only at the discretion of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205 of the Florida Administrative Code.

In accordance with subsection 28-106.111(2) and subparagraph 62-110.106(3)(a)(4), Florida Administrative Code, petitions for an administrative hearing by the applicant must be filed within 21 days of receipt of written notice.  Petitions filed by any persons other than the applicant, and other than those entitled to written notice under Section 120.60(3) of the Florida Statutes, must be filed within 21 days of publication of the notice.

Under Section 120.60(3) of the Florida Statute, however, any person who has asked the Department for notice of agency action may file a petition within 21 days of such notice, regardless of the date of publication.

The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing.  The failure of any person to file a petition for an administrative hearing within the appropriate time period shall constitute a waiver of those rights.

A petition that disputes the material facts on which the Department’s action is based must contain the following information:

(a) The name and address of each agency affected and each agency’s file or identification number, if known;

(b) The name, address, and telephone number of the petitioner; the name, address, and telephone number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests are or will be affected by the agency determination;

(c) A statement of when and how the petitioner received notice of the agency decision;

(d) A statement of all disputed issues of material fact.  If there are none, the petition must so indicate;
(e) A concise statement of the ultimate facts alleged, including the specific facts that the petitioner contends warrant reversal or modification of the agency’s proposed action; and

(f) A statement of the specific rules or statutes that the petitioner contends requires reversal or modification of the agency’s proposed action;

(g) A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wishes the agency to take with respect to the agency’s proposed action.

A petition that does not dispute the material facts on which the Department’s action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by Rule 28-106.301, Florida Adminitrative Code.  Under Sections 120.569(2)(c) and (d) of the Florida Statutes, a petition for administrative hearing must be dismissed by the agency if the petition does not substantially comply with the above requirements or is untimely filed.

This action is final and effective on the date filed with the Clerk of the Department unless a petition is filed in accordance with the above.  Upon the timely filing of petition this order will not be effective until further order of the Department.

This permit, when issued, constitutes an order of the Department.  The applicant has the right to seek judicial review of the order under Section 120.68 of the Florida Statute, by the filing of a notice of appeal under Rule 9.110 of the Florida Rules of Appellate Procedure with the Clerk of the Department in the Office of General Counsel, 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida, 32399-3000; and by filing a copy of the notice of the appeal accompanied by the applicable filing fees with the appropriate district court of appeal.  The notice of appeal must be filed within 30 days from the date when the final order is filed with the Clerk of the Department.

PUBLIC HEARING NOTICE

The Walton County Technical Review Committee will hold a public hearing on Wednesday, June 17, 2009 at 8:30 am at the South Walton Courthouse Annex in Santa Rosa Beach, FL  32459. The following items are scheduled for review and action:

1. T-MOBILE WIRELESS TELECOMMUNICATIONS FACILITY – Project number 09-001-00017.  This is a major development application submitted by Thad Watson, as agent for Powertel/Memphis, Inc., d/b/a T-Mobile.  This application seeks conditional use approval for a 250’ self-support tower and related telecommunications equipment, within a fenced compound on .23 acres with a future land use of general agriculture.  The site is at 5389 C.R. 192 (parcel number 36-4N-20-29000-004-0000).

2. BEACH FLORIDA INVESTMENTS OFFICE – Project number 09-001-00019.  This is a major development application submitted by Connelly & Wicker, Inc., consisting of a 2,000 square foot office on 0.27 acres with a future land use of NPA/infill.  The site is on the east side of C.R. 395, approximately ½ mile north of C.R. 30A (parcel number 14-3S-19-25000-004-0030).

3. TOPSAIL VILLAGE PHASE II REVISIONS – Project number 09-001-00022.  This is a minor development application submitted by Dean Burgis, requesting revisions to the previous technical approval of Phase II of the planned unit development.  These revisions consist of reducing the commercial intensity from 21,475 square feet to 12,214 square feet, which includes 7,782 square feet of general office and a 4,832 square foot restaurant with meeting rooms.  The project is on 6.47 acres with a future land use of village mixed use.  The site is on the north side of C.R.30A West, approximately one mile east of U.S. 98 (32-2S-20-33010-013-0010, 32-2S-20-33010-013-0020, 32-2S-20-33010-013-0030, 32-2S-20-33010-013-0040, 32-2S-20-33010-013-0080, 32-2S-20-33010-012-0100, and 32-2S-20-33010-012-0110).

In accordance with Section 286.26, Florida Statutes, whenever any board of commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision, which has scheduled a meeting at which official acts are to be taken receives, at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.

TO ISSUE PERMITS
This intent to issue two permits (File Nos. 66-0288504-001-DF and 66-0288504-002-DF) to Richard Stafford, 134 Grayton Trail Road, Santa Rosa Beach, FL 32459, to impact 0.02-acres of jurisdictional wetlands for the construction of a single-family home, retaining wall, and culverted driveway, with the purchase of 0.012 forested credits from Nokuse Plantation Mitigation Bank, and to impact 0.008-acres of jurisdictional wetlands for the construction of a single-family home, retaining wall, and culverted driveway, with the purchase of 0.005 forested credits from Nokuse Plantation Mitigation Bank, is hereby granted unless a sufficient petition for an administrative hearing is timely filed under sections 120.569 and 120.57 of the Florida Statutes as provided below.

The procedures for petitioning for a hearing are set forth below.

A person whose substantial interests are affected by the Department’s action may petition for an administrative proceeding (hearing) under sections 120.569 and 120.57 of the Florida Statutes.  The petition must contain the information set forth below and must be filed (received by the clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000.

Because the administrative hearing process is designed to redetermine final agency action on the application, the filing of a petition for an administrative hearing may result in a modification of the permits and lease, or even a denial of the application.  Accordingly, the applicant is advised not to commence construction or other activities under these permits/lease until the deadlines below for filing a petition for an administrative hearing, or request for an extension of time have expired.

Under rule 62-110.106(4) of the Florida Administrative Code, a person whose substantial interests are affected by the Department’s action may also request an extension of time to file a petition for an administrative hearing.  The Department may, for good cause shown, grant the request for an extension of time.   Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, before the applicable deadline.  A timely request for extension of time shall toll the running time period for filing a petition until the request is acted upon.  If a request is filed late, the Department may still grant it upon a motion by the requesting party showing that the failure to file a request for an extension of time before the deadline was the result of excusable neglect.

In the event that a timely and sufficient petition for an administrative hearing is filed, other persons whose substantial interests will be affected by the outcome of the administrative process have the right to petition to intervene in the proceeding.  Intervention will be only at the discretion of the presiding officer upon the filing of a motion in compliance with rule 28-106.205 of the Florida Administrative Code.

In accordance with rules 28-106.111(2) and 62-110.106(3)(a)(4), petitions for an administrative hearing by the applicant must be filed within 21 days of receipt of this written notice.  Petitions filed by any persons other than the applicant, and other than those entitled to written notice under section 120.60(3) of the Florida Statutes, must be filed within 21 days of publication of the notice or within 21 days of such notice, regardless of the date of publication.

Under section 120.60(3) of the Florida Statutes, however, any person who has asked the Department for notice of agency action may file a petition within 21 days of such notice, regardless of the date of publication.

The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing.  The failure of any person to file a petition for an administrative hearing or pursue mediation as provided below within the appropriate time period shall constitute a waiver of those rights.

A petition that disputes the material facts on which the Department’s action is based must contain the following information:

(a) The name and address of each agency affected and each agency’s file or identification number, if known;

(b) The name, address, and telephone number of the petitioner; the name, address, and telephone number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests are or will be affected by the agency determination;

(c) A statement of when and how the petitioner received notice of the agency decision;

(d) A statement of all disputed issues of material fact.  If there are none, the petition must so indicate;

(e) A concise statement of the ultimate facts alleged, including the specific facts that the petitioner contends warrant reversal or modification of the agency’s proposed action; and

(f) A statement of the specific rules or statutes that the petitioner contends requires reversal or modification of the agency’s proposed action;

(g) A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wishes the agency to take with respect to the agency’s proposed action.

A petition that does not dispute the material facts on which the Department’s action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by rule 28-106.301.  Under sections 120.569(2)(c) and (d) of the Florida Statutes, a petition for administrative hearing must be dismissed by the agency if the petition does not substantially comply with the above requirements or is untimely filed.

This action is final and effective on the date filed with the Clerk of the Department unless a petition is filed in accordance with the above.  Upon the timely filing of petition this order will not be effective until further order of the Department.

These permits constitute an order of the Department.  The applicant has the right to seek judicial review of the order under section 120.68 of the Florida Statutes, by the filing of a notice of appeal under rule 9.110 of the Florida Rules of Appellate Procedure with the Clerk of the Department in the Office of General Counsel, 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida, 32399-3000; and by filing a copy of the notice of the appeal accompanied by the applicable filing fees with the appropriate district court of appeal.  The notice of appeal must be filed within 30 days from the date when the final order is filed with the Clerk of the Department. Requests for review before the Land and Water Adjudicatory Commission must be filed with the Secretary of the Commission and served on the Department within 20 days from the date when the final order is filed with the Clerk of the Department.

The application is available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at Department of Environmental Protection, 160 Governmental Center, Suite 201, Pensacola, Florida 32502-5794.
