The Walton County Technical Review Committee will hold a public hearing on Wednesday, May 20, 2009 at 8:30 am at the South Walton Courthouse Annex in Santa Rosa Beach, FL 32459. The following items are scheduled for review and action:

1. BAYPORT COMMERCIAL COMPLEX FILL PLACEMENT – Project number 09-001-00016. This is a minor development order application submitted by ECA, Inc., requesting fill replacement on the subject property, in compliance with approved Florida Department of Environmental Protection and Army Corps of Engineer permits for this project. The petition must contain the information set forth below and must be filed (received by the clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000.

Because the administrative hearing process is designed to redetermine final agency action on the application, the filing of a petition for an administrative hearing may result in a modification of the permit and lease, or even a denial of the application. Accordingly, the applicant is advised not to commence construction or other activities under this permit/lease until the deadlines below for filing a petition for an administrative hearing, or request for an extension of time have expired.

Under rule 62-110.106(4) of the Florida Administrative Code, a person whose substantial interests are affected by the Department’s action may also request an extension of time to file a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time. Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, before the applicable deadline. A timely request for extension of time shall toll the running time period for filing a petition until the request is acted upon. If a request is filed late, the Department may still grant it upon a motion by the requesting party showing that the failure to file a request for an extension of time before the deadline was the result of excusable neglect.

In the event that a timely and sufficient petition for an administrative hearing is filed, other persons whose substantial interests will be affected by the outcome of the administrative process have the right to petition to intervene in the proceeding. Intervention will be only at the discretion of the presiding officer upon the filing of a motion in compliance with rule 28-106.205 of the Florida Administrative Code.

In accordance with rules 28-106.111(2) and 62-110.106(3)(a)(4), petitions for an administrative hearing by the applicant must be filed within 21 days of receipt of this written notice. Petitions filed by any persons other than the applicant, and other than those entitled to written notice under section 120.60(3) of the Florida Statutes, must be filed within 21 days of publication of the notice or within 21 days of such notice, regardless of the date of publication.

Under section 120.60(3) of the Florida Statutes, however, any person who has asked the Department for notice of agency action may file a petition within 21 days of such notice, regardless of the date of publication.

The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing. The failure of any person to file a petition for an administrative hearing or pursue mediation as provided below within the appropriate time period shall constitute a waiver of those rights.

A petition that disputes the material facts on which the Department’s action is based must contain the following information:

(a) The name and address of each agency affected and each agency’s file or identification number, if known;

(b) The name, address, and telephone number of the petitioner; the name, address, and telephone number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests are or will be affected by the agency determination;

(c) A statement of when and how the petitioner received notice of the agency decision;

(d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate;

(e) A concise statement of the ultimate facts alleged, including the specific facts that the petitioner contends warrant reversal or modification of the agency’s proposed action; and

(f) A statement of the specific rules or statutes that the petitioner contends requires reversal or modification of the agency’s proposed action;

(g) A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wishes the agency to take with respect to the agency’s proposed action.

A petition that does not dispute the material facts on which the Department’s action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by rule 28-106.301. Under sections 120.569(2)(c) and (d) of the Florida Statutes, a petition for administrative hearing must be dismissed by the agency if the petition does not substantially comply with the above requirements or is untimely filed.

This action is final and effective on the date filed with the Clerk of the Department unless a petition is filed in accordance with the above. Upon the timely filing of petition this order will not be effective until further order of the Department.

This permit constitutes an order of the Department. The applicant has the right to seek judicial review of the order under section 120.68 of the Florida Statutes, by the filing of a notice of appeal under rule 9.110 of the Florida Rules of Appellate Procedure with the Clerk of the Department in the Office of General Counsel, 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida, 32399-3000; and by filing a copy of the notice of the appeal accompanied by the applicable filing fees with the appropriate district court of appeal. The notice of appeal must be filed within 30 days from the date when the final order is filed with the Clerk of the Department. Requests for review before the Land and Water Adjudicatory Commission must be filed with the Secretary of the Commission and served on the Department within 20 days from the date when the final order is filed with the Clerk of the Department.

The Department of Environmental Protection gives notice of its preparation of a draft permit and Administrative Order for the South Walton Utility Company, Inc. WWTP to the South Walton Utility Company, Inc., 369 Miramar Beach Drive, Miramar Beach, FL 32550 for renewal of existing 2.5 MGD monthly average daily flow (MADF) permitted capacity extended aeration wastewater treatment plant capacity. This permit authorizes continuation of construction and operation that was granted by permit revision FL0102482-006-DW1P/RA effective September 4, 2007 to upgrade the treatment plant to accomplish advanced wastewater treatment (AWT) and to expand the wastewater treatment plant capacity to 2.75 MGD annual average daily flow (AADF). The treatment plant will operate in the extended aeration mode and will have provisions for pretreatment, equalization, nitrification, denitrification, clarification, tertiary filtration, high level disinfection, dechlorination, aerobic sludge digestion, and residual handling system.

The reclaimed water is reused either by an existing 4.355 MGD AADF permitted capacity general service area, R-001, for Part III public access reuse system or it is directed to rapid infiltration basin system, R-002, consisting of 12 rapid infiltration basins located approximately at latitude 30°22’44.5” N, longitude 86°21’47.1” W. Surface Water Discharge, D-001, initially permitted by revision FL0102482-006-DW1P/RA on September 4, 2007 is a 1.35 MGD MADF backup discharge to unnamed FDOT ditch system adjacent to the west side of the WWTP along Highway 98, flowing to Choctawhatchee Bay. The point of discharge is located approximately at latitude 30°22’55.1” N, longitude 86°21’28.9” W. This permit also authorizes a new 2.0 MGD AADF permitted discharge, D-002, Wetland Application System, a receiving freshwater wetlands system consisting of four wetland basins SW-2, SW-5, SW-10 and SW-8 totaling approximately 259.4 acres, which flow to Choctawhatchee Bay located in Walton and Okaloosa Counties, approximately at latitude 30°23’25.6” N, longitude 86°24’58.7” W.
The Department has permitting jurisdiction under Sections 403.087 and 403.0885, Florida Statutes and Rules 62-4, 62-600, 62-601, 62-302, 62-611, 62-620, 62-640, 62-650 and 62-699, Florida Administrative Code.

Any interested person may submit written comments on the draft permit of the Department or may submit a written request for a public meeting to Tariq Mian, Northwest District Office, Florida Department of Environmental Protection, 160 Governmental Center, Room 302, Pensacola, FL 32502-5794 (tariq.mian@dep.state.fl.us) in accordance with rule 62-620.555 of the Florida Administrative Code. The comments or request for a public meeting must contain the information set forth below and must be received in the Office within 30 days of publication of this notice. Failure to submit comments or request a public meeting within this time period shall constitute a waiver of any right such person may have to submit comments or request a public meeting under Rule 62-620.555, Florida Administrative Code.

The comments or request for a public meeting must contain the following information:

(a) The commenter’s name, address, and telephone number, the applicant’s name and address, the Department Permit File Number and the county in which the project is proposed;

(b) A statement of how and when notice of the Department action or proposed action was received;

(c) A statement of the facts the Department should consider in making the final decision;

(d) A statement of which rules or statutes require reversal or modification of the Department action or proposed action; and

(e) If desired, a request that a public meeting be scheduled including a statement of the nature of the issues proposed to be raised at the meeting. PUBLIC HEARING NOTICE

The Walton County Zoning Board of Adjustment will hold their regular public hearing on May 28, 2009 at 6:00 P.M. at the South Walton Courthouse Annex in Santa Rosa Beach, Florida 32459. The following items are scheduled for review and action:

1. ANNIE BOWES PETITION FOR VARIANCE – Project number 09-005-00003. This is a petition submitted by Annie Bowes and Donald Marden, for a variance from the Walton County Land Development Code, section 5.00.03, to reduce the front setback from 20 feet to 13.8 feet, to allow an existing structure to remain as constructed, encroaching 6.2 feet. The site is at 65 Island Grove Drive (parcel number 29-1S-19-23010-00D-0380).

2. D & H SAND PIT SPECIAL EXCEPTION – Project number 08-017-00001. This is a special exception application submitted by Emerald Coast Associates for Djuna Cheatum, requesting approval of mining sand on 121.7 acres with a future land use of large-scale agriculture. The site is at 760 Sand Plant Road, off Rock Hill Road (parcel number 18-2N-17-05000-004-0020).

The Zoning Board of Adjustment will make a final determination to grant a variance, deny a variance, uphold the director’s decision, overturn the director’s decision, or continue to a later date. Any agenda item that is tabled will be scheduled for a future Zoning Board of Adjustments meeting. The applicant/petitioner may appeal the decision of this board to the Circuit Court of Walton County.

In accordance with Section 286.26, Florida Statutes, whenever any board or commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision that has scheduled a meeting at which official acts are to be taken, receives at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting, directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.

In accordance with Section 286.0105, Florida Statutes, all persons are advised that, if a person decides to appeal any decision made by the board, agency, or commission with respect to any matter considered at such meeting or hearing, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.

NOTICE OF PUBLIC HEARING

The Walton County Board of County Commissioners will hold a regular meeting on Tuesday, May 26, 2009, at 5:00 p.m. or as soon thereafter as may be heard at the Walton County Courthouse located at 571 U.S. Highway 90, DeFuniak Springs, Florida. The following items will be heard:

LEGISLATIVE ITEMS:

1. EAR-BASED AMENDMENT TO THE FUTURE LAND USE ELEMENT – Request that the Board consider Planning Commission recommendations on the proposed amendments to the Future Land Use Element of the Walton County Comprehensive Plan based upon the county’s Evaluation and Appraisal Report, as well as recommendations from the public.

QUASI-JUDICIAL ITEMS:

2. MACK BAYOU OFFICE BUILDING – Project number 09-001-00012. This is a major development order application submitted by Jenkins Engineering, Inc., consisting of re-development of an existing structure on .517 acres with a future land use of NPA/infill. The site is on Mack Bayou Road, approximately .8 mile north of U.S. 98 (parcel number 25-2S-21-42350-000-0120).

All interested parties wishing to be heard regarding these amendments may appear at the above mentioned meeting.
